ii. National Older American Volunteer Programs for persons <br />aged 60 and over which include Retired Senior Volunteer <br />Programs, Foster Grandparent Program, Older American <br />Community Services Program, and National Volunteer <br />Program to Assist Small Business Experience, Service <br />Corps of Retired Executive (SCORE) and Active Corps of <br />Executives (ACE). <br />Household means all the persons who will occupy the Inclusionary Unit. A child <br />who is subject to a legally- binding shared- custody agreement, in which the child <br />resides with the Household at least 50% of the time, is counted as a mernber of <br />the Household. Excluded from the definition of Household are live -in <br />caregivers /caretakers, foster children, unborn children and children being <br />pursued for legal custody or adoption that are not currently living with the <br />Household. <br />HCD means the California Department of Housing and Community Development. <br />HUD means the United States Department of Housing and Urban Development. <br />Inclusionary Housing Plan means a plan submitted for approval to the Program <br />Director that details the manner in which the Inclusionary Housing obligations will <br />be fulfilled by the Project. The approved Inclusionary Housing Plan (i) is <br />attached as Exhibit 4 to and incorporated in its entirety within this Inclusionary <br />Housing Agreement and (ii) shall be deemed a substantive part of this <br />Inclusionary Housing Agreement. <br />Inclusionary Unit means a rental unit in within the Project that is made <br />affordable by covenants or conditions restricting occupancy and rental rate <br />charged as set forth within the Inclusionary Housing Plan and which is occupied <br />by an Eligible Tenant. <br />Low Income refers to Households whose incomes meet the standards defined <br />by the H &SC Section 50079.5. Generally, Low Income means household <br />income that does not exceed 80% of the County Median Income, as adjusted for <br />Household size. However, the maximum household income amount for Low <br />Income Households shall be set at the amount published by HCD annually. <br />Low Income Household means individuals or Households who have an <br />adjusted Gross Income that does not exceed Low Income. <br />Inclusionary Housing _Agreement— Rerital Project —Page-7 <br />City of Santa Ana 19H-9 September 18, 2014 <br />
