Environmental Analysis <br />UTILITIES AND SERVICE SYSTEM <br />Without mitigation, the following impacts would be potentially significant: <br />■ Impact 5.14 -1 Buildout of the Harbor Corridor Plan would exceed the wastewater capacity of the <br />sewer pipelines. <br />■ Impact 5.14 -2 Buildout of the Harbor Corridor Plan may exceed the water capacity of the existing <br />water pipelines. <br />■ Impact 5.14 -3 Buildout of the Harbor Corridor Plan would increase runoff from the site, <br />requiring drainage improvements to accommodate project generated runoff as well <br />as to remedy existing deficiencies. <br />5.14.7 Mitigation Measures <br />Impact 5.14 -1 <br />14 -1 Prior to the first building permit pursuant to the proposed project, the City of Santa Ana <br />shall prepare a "Nexus" Study that will serve as the basis for requiring development impact <br />fees under AB 1600 legislation, as codified by California Code Government Section 66000 et <br />seq. The established procedures under AB 1600 require that a "reasonable relationship" or <br />nexus exist between the water and sewer infrastructure improvements and facilities required <br />to mitigate the sewer impacts of new development pursuant to the proposed project. The <br />sewer segment improvements shown on Table 5.1411 of the DEIR are necessary to <br />mitigate project impacts and shall be included, among other improvements, in the AB 1600 <br />nexus study. <br />14 -2 Prior to the issuance of the first building permit pursuant to the proposed project, the City <br />of Santa Ana shall prepare a Development Fee program pursuant to the AB 1600 Nexus <br />Study identified in Mitigation Measure 141, above. The Development Fee program would <br />fund the Harbor Corridor Plan area wide water and sewer infrastructure improvements. The <br />fee program shall stipulate that fees are assessed when there is new construction or when <br />there is an increase in square footage within an existing building or the conversion of <br />existing square footage to a more intensive use. Fees are calculated by multiplying the <br />proposed square footage or dwelling unit by the rate identified. The fees are included with <br />any other applicable fees payable at the time the building permit is issued. The City will use <br />the development fees to fund construction (or to recoup fees advanced to fund <br />construction) of the infrastructure improvements identified in Mitigation Measure 141. <br />14 -3 Prior to the issuance of a grading permit, the project applicant shall prepare water and sewer <br />studies and identify the sizing and location of backbone facilities necessary to serve the <br />proposed project, in accordance with City standards. The water and sewer plans shall be <br />submitted to the City's Public Works Agency for review and approval. Design of facilities <br />that serve the project shall be sufficient to meet the projected service demands. <br />October 2014 Page 5.14 -23 <br />
