Harbor Boulevard Mixed Use Transit Corridor Plan <br />Findings and Facts in Support of Findings and Statement of Overriding Considerations <br />EIRs, or other materials incorporated by reference in the Draft EIR and Final EIR. <br />The reports and technical memoranda included or referenced in the Response to <br />Comments of the Final EIR; <br />• All written comments submitted by agencies and members of the public during the <br />45 -day public review comment period on the Draft EIR and testimony provided at the <br />May 12, 2014 Planning Commission public hearing; <br />• All responses to written comments submitted by agencies and members of the <br />public; <br />• All testimony provided by agencies and members of the public at the City Council <br />public hearings tentative scheduled on September 15, 2014, <br />• All final City Staff Reports relating to the Draft EIR, Final EIR, and the project; <br />• All other public reports, documents, studies, memoranda, maps, or other planning <br />documents relating to the project, the Draft EIR, and the Final EIR prepared by the <br />City, consultants to the City, or Responsible or Trustee Agencies. <br />• The Mitigation Monitoring and Reporting Program (MMRP) adopted by the City for <br />the project; the Ordinances and Resolutions adopted by the City in connection with <br />the proposed project; and all documents incorporated by reference therein; <br />• These Findings of Fact and Overriding Considerations adopted by the City for the <br />project, any documents expressly cited in these Findings of Fact; <br />• Any other relevant materials required to be in the record of proceedings by Public <br />Resources Code Section 21167.6(e). <br />The documents and other material that constitute the record of proceedings on which these <br />findings are based are located at the City of Santa Ana Planning and Building Agency. The <br />custodian for these documents is the City of Santa Ana. This information is provided in <br />compliance with Public Resources Code Section 21081.6(a)(2) and 14 California Code <br />Regulations Section 15091(e). <br />4. ENVIRONMENTAL ISSUES THAT WERE DETERMINED TO BE LESS THAN <br />SIGNIFICANT <br />Impacts Determined Less than Significant in the Initial Study <br />As a result of the Notice of Preparation circulated by the City on June 11, 2013, in connection <br />with preparation of the EIR, the City determined, based upon the threshold criteria for <br />significance, (Appendix G of the CEQA Guidelines) that the project would have no impact or a <br />less than significant impact on the following potential environmental issues, and therefore, <br />determined that these potential environmental issues would not be addressed in the Draft EIR. <br />Based upon the environmental analysis presented in the EIR, and the comments received by <br />the public on the Draft EIR, no substantial evidence was submitted or identified by the City <br />which indicated that the project would have an impact on the following environmental areas: <br />12 July 2014 <br />
