Assessment of fees on a traffic related basis was determined to <br />be equitable. Trip ends were selected as the least common <br />denominator and fees were established by dividing the <br />proportion of corridor cost attributable to each fee zone by <br />the total number of projected daily trip ends within each fee <br />zone. Adjustments were made to trip ends between neighborhood <br />commercial and residential land uses to reflect the relative <br />benefit of neighborhood commercial development to residences. <br />Land uses were combined into three general land use categories <br />(2 residential and 1 non - residential) for the purposes of <br />applying fees to development projects. <br />Presently, as of September 14, 1988, fees for each of the fee <br />zones within the areas of benefit are: <br />SJHTC <br />Single Family <br />Multi -Unit <br />Non - Residential <br />Residential <br />Residential <br />Zone A <br />$ 1,372 /unit <br />$ <br />799 /unit <br />$ <br />1.84 /sf. <br />Zone B <br />$ 1,062 /unit <br />$ <br />620 /unit <br />$ <br />1.36 /sf. <br />F /ETC <br />Zone A <br />$ 1,360 /unit <br />$ <br />794 /unit <br />$ <br />1.89 /sf. <br />Zone B <br />$ 967 /unit <br />$ <br />563 /unit <br />$ <br />1.10 /sf. <br />Developers who are required to construct portions of the <br />transportation corridors will receive credit for that work <br />toward the payment of their fees by the Transportation Corridor <br />Agency pursuant to approved plans, specifications and phasing <br />of the Agency, or by agreements with Parties executed prior to <br />the effective date of this First Amended and Restated <br />Agreement. The amount of credit neither will be adjusted with <br />subsequent revisions to the fee program nor will additional <br />fees based upon such subsequent revisions be required once such <br />credit is memorialized by agreement. This credit may be <br />transferred in accordance with the provisions of Section XI to <br />subsequent owners of the property from which the credits were <br />generated. . <br />Payment of fees for residential multi -unit rental projects may <br />be deferred for a period of five years from issuance of a <br />building permit. The developer must enter into an agreement to <br />pay the fee in effect at the time payment is due and provide a <br />security in the amount of the fee plus 15 %. <br />Properties which are exempt from payment of property taxes will <br />generally be exempt from payment of corridor fees. <br />Governmental owned and constructed facilities and utilities <br />will be exempt unless the facility is used for commercial or <br />revenue generating purposes. <br />-2- <br />
