Ross, Exec" utive Directo <br />From: Public Works Agency <br />RESOLUTION APPROVING AMENDMENT NO. 2 TO THE "FIRST AMENDED AND RESTATED JOINT <br />Subject: EXERCISE OF POWERS AGREEMENT CREATING THE SAN JOAQUIN HILLS TRANSPORTATION <br />CORRIDOR AGENCY" <br />STATEMENT OF THE ISSUE <br />The County of Orange, the City of Santa Ana, and seven other cities that would <br />benefit from the construction of the San Joaquin Hills Transportation Corridor <br />are members of the Transportation Corridor Agency. On December 1, 1989, the <br />City of Laguna Niguel was incorporated, and has requested admission as a party <br />to the San Joaquin Hills Transportation Corridor Agency. On February 6, 1990, <br />the City of Laguna Niguel will conduct a public hearing and it is anticipated <br />that the City will comply with Section 4.1 of the "First Amended and Restated <br />Joint Exercise of Powers Agreement Creating the San Joaquin Hills <br />Transportation Corridor Agency," by enactment of an ordinance adopting the <br />Major Thoroughfare and Bridge Fee Program of the Agency, and a resolution <br />establishing the areas of benefit, estimated cost, and required fees. <br />Section 9.1 of the Agreement requires unanimous consent of each existing party <br />for admission of the City as a party. Inclusion of the City of Laguna Niguel <br />as a member of the Transportation Corridor Agency will ensure that each of the <br />areas of benefit contribute their fair share of the cost for the San Joaquin <br />Hills Transportation Corridor. <br />ALTERNATIVES CONSIDERED <br />The alternative is to not approve the Resolution admitting the City of Laguna <br />Niguel as a party to the San Joaquin Hills Transportation Corridor Agency. <br />This alternative is not recommended, since it would not enable the Agency to <br />finance the construction of the San Joaquin Hills Transportation Corridor. <br />FISCAL IMPACT <br />There is no direct fiscal impact on the City of Santa Ana. <br />RECOMMENDED ACTION <br />Adopt th-- a reso u ion approving Amendment No. 2 to the "First Amended and <br />Restated Joint Exercise of Powers Agreement Creating the San Joaquin Hills <br />Transportation Corridor Agency." <br />James G.
