B. Role and Responsibility of Management Agent <br />The Agent shall operate and manage the Property in accordance with the <br />provisions stated in the Management Agreement. <br />The Agent, based on previous experience with effective management practice, <br />shall provide advice and recommendations to the Owner to establish general <br />policies for the operation of Vista del Rio. Additionally, the Owner and the Agent <br />will establish additional management policies, as needed. Such policies shall <br />include, but are not limited to: <br />a. The intake process which includes the affirmative marketing plan; <br />b. The tenant selection criteria and wait list management; <br />c. House rules; <br />d. Evictions and eviction prevention policies, <br />e. Security and emergency after hour services; <br />f. Supportive services including substance abuse policy and services; <br />g. Reasonable accommodation procedures; <br />h. Confidentiality policy; <br />i. Communications between Services and Property Management; <br />j. Site - specific performance standards <br />k. Maintenance including training of site staff and tenants in green education; <br />and <br />1. Tenant employment and volunteer activities. <br />Once the policies have been established by the Owner, the Owner shall delegate <br />authority to the Agent to implement the policies. The Agent will, by means of <br />periodic budgets, financial statements, and status reports, inform the Owner on the <br />operation of the Property. In addition, the following procedures shall be followed <br />to ensure effective day -to -day operations and cooperation between the Owner and <br />Agent: <br />1. The Agent and Owner shall enter into a Management Agreement that will <br />provide detailed responsibilities that the Agent and Owner will assume. <br />The responsibilities shall be clearly assigned and described, and shall not <br />overlap. <br />2. Agent shall operate and manage the Property in accordance with the <br />provisions set forth in the Management Agreement. In its operation and <br />management of the same, Agent shall generally and specifically in <br />accordance with the terms of the Management Agreement, collect all <br />income from its operation of the Property, and pay all expenses to the <br />extent that income is available to do so. <br />Exhibit H - 5 - <br />
