well maintained condition. This specification is designed to continuously improve parks and public <br />recreational sites. It is with this intent in mind that the Director's Representative may consider <br />authorizing extra work. Extra work will not be initiated without written authorization. In emergency <br />situations, a not to exceed price may be submitted by contractor via e-mail for review /approval by City. <br />The Director's Representative may request that the Contractor submit proposals for extra work in order <br />to repair or improve the grounds - landscape in the contract sites. The Contractor shall submit proposals <br />using the City's Proposal for Authorization for Extra Work (AEW) spreadsheet. The Contractor shall <br />complete the spreadsheet in its entirety using his /her proposed extra work pricing (that is a part of this <br />agreement) in order for the proposal to be considered. City reserves the right to request <br />materials /equipment receipts with invoices. All labor shall be quoted on a "not to exceed" basis and <br />City will only pay for labor actually incurred. City will pay up to 10% mark -up on parts. <br />D. OUTSIDE OF SCOPE <br />Damage or malfunction to plant material or irrigation system equipment (from valve to water meter), <br />with the exception of irrigation heads and lateral lines, by any of the following may be considered <br />outside the scope of this Agreement: <br />(1) Acts of God <br />(2) Civil Disorder <br />(3) Vehicle Collision (excluding Contractor and its employees and subs) <br />(4) Excavation or re- surfacing of the street <br />(5) Power failures <br />(6) Underground wiring damage <br />Contractor will not be considered responsible for replacement. Contractor must prove to the <br />satisfaction of Director that one of the above occurred in order to be excused from performing under the <br />Agreement. <br />1. Scheduling of Work — Routine Maintenance <br />a) The Contractor shall provide landscape /grounds maintenance between the hours of <br />6:00 a.m. and 6:00 p.m., Monday through Sunday. The schedule may be modified only <br />with the Director's Representative consent. Landscape /grounds maintenance that <br />generates excess noise cannot begin before 8:00 a.m. <br />b) The Contractor shall establish schedules of "routine work" to be followed in the <br />performance of this contract. In addition to the Contractor submitting the Monthly Park <br />Maintenance Inspector's Inspection Schedule and other required monthly reports, the <br />Contractor shall submit weekly schedules listing the work tasks, crew performing the <br />task, and the projected hours to complete the task. The schedules shall be emailed to <br />Director's Representative by Thursday at 4:OOpm for the upcoming week. Any changes <br />in scheduling shall be reported in writing 48 hours before the proposed change and must <br />be approved by the Director's Representative. The schedule shall include days of the <br />week and what person /crew will be performing specific work in accordance with the <br />specification. <br />2. Work Force <br />The Contractor shall provide the number of staff that shall significantly improve the quality of the <br />parks per the specifications and attachments. The City shall determine what the "appropriate <br />number" of certified staff shall be based upon the existing condition of the irrigation systems and <br />the overall health of the landscapes. Your proposal will be evaluated on the qualifications of the <br />individuals and the amount of FTE's you assign to each district. Copy of certificates and <br />qualifications is required with proposal submittal. <br />Page 7 <br />
