which may be required pursuant to this Housing Plan has been submitted, if that <br />information is not included with the initial application submittal. <br />(b) Qualification Approved, Prior to renting or leasing an Inclusionary Unit, Property Owner <br />will certify the eligibility of the prospective Low Income Household tenant. The <br />certification shall be made on forms substantially similar to those attached as Exhibit C. <br />Where there are more Eligible Tenants than there are available Inclusionary Units, a <br />waiting list shall be created (the "Waiting List "), <br />(c) Qualification Denied. If an applicant for an Inclusionary Unit is rejected, that applicant will <br />be given prompt written notice of the rejection and the reasons forthe rejection. <br />(d) No Dlscriminotlon. In making its determination, Property Owner shall not discriminate <br />against any person or group of persons, on account of race, color, religion, sex, sexual <br />orientation, marital status, natural origin, ancestry, familial status, source of income or <br />disability. <br />Priorities Among Applicants <br />Where there is more than one Eligible Tenant for an available Inclusionary Unit or where an <br />Eligible Tenant is on the Waiting List, first priority will be given to qualified Low Income <br />Households with one or members who, at the time the application is complete, (1) live In the <br />City of Santa Ana or (2) Is a veteran of the United States Armed Forces. <br />Recertification of Tenant Eligibility <br />(a) Annual Review. The Property Owner or property manager must establish an annual <br />schedule to recertify that each tenant in an Inclusionary Unit remains an Eligible Tenant. <br />All tenant recertifications for the Inclusionary Units must be performed at the same time <br />each year. <br />(b) Continued income Qualification and Vacated Inclusionary Units. If the recertification <br />demonstrates that a previously Eligible Tenant's Gross Household Income exceeds the Low <br />Income standard applied to the Inclusionary Unit, the pertinent actions from the following <br />list must be taken; <br />i. The Property Owner may offer to rent the unit to the previously, but no longer, <br />Eligible Tenant as a Market Rate Unit without any limitations on rental rates. In that <br />case, the Property Owner must then make available for rent to an Eligible Tenant <br />another unit within the Project that meets the size and location requirements for <br />Inclusionary Units under this Housing Plan. If there are no vacant units meeting <br />those requirements, then the next available unit within the Project which does meet <br />those requirements must be rented to an Eligible Tenant. <br />4 <br />
