City Attorney Carvalho, noted that law does allow such contracting, but <br />need to review documents; City Council right to adopt policy on such <br />matters. <br />Councilmember Tinajero, suggested matter be continued to next Council <br />meeting to allow staff to review bid proposal. <br />Mayor Pulido, noted that matter is time sensitive because bid proposal <br />expiring and would like to repair parking lot during the Summer in time for <br />Fall session. <br />Councilmember Martinez, indicated that it was important to protect the <br />City; no exposure. Direct City Attorney to work with District attorney on <br />detail of the proposal. <br />Rancho Santiago Community College District Chancellor Raul Rodriguez, <br />indicated that bid proposal expiring June 2, 2015; need to award contract <br />at their next regularly scheduled Board meeting; followed bid procedures, <br />but willing and able to work with the City. <br />City Manager Cavazos, urged all to manage expectations and allow <br />detailed review of proposal. <br />City Attorney Carvalho, many joint use contracts have been approved, but <br />need to make sure contractor indemnifies City. <br />Mayor Pro Tern Sarmiento, supports policy that cures problem; opined <br />that current condition of the lot needs to be repaired but not in dire <br />condition; City has mitigated problem in the past; contract need to reflect <br />that City owns land. <br />Chancellor Rodriguez, noted that OC Water District has been contacted <br />and amenable to making project move forward. <br />Councilmember Reyna, concerned that City staff not involved in the <br />process; OC Water District has begun to make community presentations <br />on proposed improvements; supports District paying for parking lot <br />improvements; urge better communication between agencies. <br />Councilmember Amezcua, asked if bid could be extended and if City <br />obligated to reimburse the OC Water District when they make <br />improvements. <br />City Attorney Carvalho, noted that District has followed their process; bid <br />expiring with no extension. <br />City Manager Cavazos noted for the record that parking lot is safe; City <br />Engineer has inspected the lot. <br />CITY COUNCIL MINUTES 5 MAY 19, 2015 <br />1 0A -5 <br />
