If, wtth respect lo · suspension, demotion, or dismissal, the Per- <br /> Sonnel Board conciudec that such suspension, demotion, or dismissal <br /> was warranted, any recommendation by it shall be advisory only and <br /> ahall not be binding on the appointing power and, in such instance, the <br /> decision of the appointing power shall be final and no appeal may be <br /> taken ~therefrom. <br /> Vacancies created under this Section may be filled by the appoint- <br />lng power by temporary appointment pending the completion of any <br />proceedings taken hereunder. <br /> A reduction in pay shall bo treated as · demotion under this Sec. <br />Sion, unless the reduction in pay is part of a plan to reduce salaries and <br />wages in connection with · general economy or curtailment program. A <br />failure to grant an increase in pay at a time when an increase would <br />otherwise have been granted as part of a plan to increase salaries and <br />wages throughout the City service shall likewise be treated as a demo- <br />tion under this Section. <br /> <br /> Section 1009. ABOLITION OF POSITIONS, LAY.OFFS. No provi- <br />sions ~f this Article shall be construed as interfering with the power of <br />the City Council by stating in its proceedings its reasons therefor, to <br />abofish I position, combine the duties of two or more positions, or <br />reduce the number of employees in a given class except as specifically <br />provided in Article VII of this Charter. Should an abolished position be <br />renewed or a combined position be separated or any position or posi- <br />tions involving substantially the same duties be created or filled within <br />two years, the employee or employees discharged shall be entitled to <br />be appointed thereto. <br /> <br /> All lay-offS occasioned by the abolishment of aposition, the combin- <br />ation of duties of two or more positions, or the reduction In number of <br />employees in · given class shall bo governed by seniority in service and <br />shall be in the reverse order of employment. Re-employment shall be in <br />the reverse order of lay.offs. <br /> <br /> Section 1010. PROHIBITIONS. No person in a position, office, <br />or employment in the servicu of the City of Santa Ama or who is an <br />applicant for appointment thereto shall in any way be favored or dis- <br />criminated against because of his race, religion, or political opinions. <br /> <br /> No person holding any position in the service of the City, excepting <br />elective officers and members of appointive boards and commissions, or <br />on an eligible list, shaft lake an active part in any municipal political <br />campaign in behalf of any candidate, or contribute thereto, nor shall <br />such person seek signatures to eny petition to advance the candidacy of <br />any person for any municipal office. Nothing in this Section shall be <br />construed to prevent any such persons from seeking election or appoint- <br />mens to public offce.
