Any incurred overtime pay for such <br />services will be reimbursed at the applicable overtime rate for the transportation officer <br />Position specified in Article I. C., Rates. Overnight lodging resulting from transportation <br />services shall be approved in advance by the COR or designated ICE official. All <br />transportation services shall be accomplished in an appropriate and economical manner. <br />C, The Service Provider personnel provided for the above services shall be of the same <br />qualifications, receive the same training, complete the same security clearances, and wear <br />the same uniforms as those Service Provider personnel provided in the other areas of this <br />Agreement. Transportation officers shall have the required state licenses for coturnercial <br />drivers with the proper endorsement limited, to vehicles with Automatic Transmission and <br />the state Department of Motor Vehicles (DMV) (or Motor Vehicles Department (MVD)) <br />Medical Certification, <br />D, Transport /Escort/stationary Services Rateā€¢ The Service Provider agrees, upon request of <br />ICE in whose custody an ICE detainee is held, to provide all such ground <br />transportation/escort /stationary services as may be required to transport detainees <br />securely, in a timely manner, to locations as directed by the ICE COR or designated ICE <br />official. At least two (2) qualified law enforcement or correctional of8oer personnel <br />employed by the Service Provider under their policies, procedures and practices shall <br />perform transport services. As written above, except in emergency situations females <br />may not be transported by bus for more than ten hours. Furthermore, except in <br />emergency situations, a single officer may not transport a single detainee of the opposite <br />gender and if there is an expectation that a pat search will occur during transport, an <br />officer of the same gender as the dotanioe(s) must be present. <br />E. Medical Legal Transportation: The Service Provider shall provide transportation and <br />escort guard services for ICE detainees to and from a medical facility for outpatient care <br />and attending off-site court proceedings, An officer or officers shall keep the detainee <br />under constant supervision twenty -roux (24) hours per day until the detainee is ordered <br />released from the hospital, or at the order of the COR, The number of escorts will be <br />determined by the COR. The Service Provider agrees to augment such practices as may <br />be requested by ICE to enhance specific requirements for security, detainee monitoring, <br />visitation, and contraband control. <br />F. The Service Provider shall, upon order of the COR, or upon its own decision in an urgent <br />medical situation with notification to the COR immediately thereafter, transport a <br />detainee to a hospital location. An officer(s) shall keep the detainee under supervision 24 <br />hours per day rmtil the detainee is ordered released from the hospital, or at the order of <br />the COR. The Service Provider shall then return the detainee to the Facility. The Service <br />Provider will ensure that at least one officer responsible for the security of the detainee <br />while he /she is an ha- patient at the hospital will be of the same sex as the detainee. <br />G. Indemnities: Furthermore, the Service Provider agrees to hold harmless and indemnify <br />DHS /ICE and its officials in their official and individual capacities from any liability, <br />19 <br />25G -22 <br />
