government within 45 days of receipt of the funds. For SHSP awards, no pass <br />through requirements will be applied to the District of Columbia, Guam, American <br />Samoa, the US. Virgin Islands, and the Commonwealth of the Northern Mariana <br />Islands. Any UASI funds retained by the SAA must be used to directly support the <br />designated Urban Areas in the State. <br />Under SHSP, the State may retain more than 20 percent (20 %) of SHSP funding for <br />expenditure made by the State on behalf of the local unit(s) of government. This may <br />ocour only with the written consent of the local unit of government, with the written <br />consent specifying the amount of funds to be retained and the intended use of funds. <br />If a written consent agreement is already in place from previous fiscal years, FEMA <br />will continue to recognize it for FY 2014. I£ any modifications to the existing <br />agreement are necessary to reflect new initiatives, States should contact their assigned <br />FEMA Program Analyst. <br />If UASI fiends are used by the SAA in support of the Urban Area, the SAA must <br />propose an Investment describing how UASI funds will be used by the SAA to <br />directly support the Urban Area. <br />OPSG Pass - Through Requirement <br />The recipient must pass through 100 percent (100 %) of OPSG allocations to eligible <br />jurisdictions. The recipient is prohibited from obligating or expending funds provided <br />through this award until each wiique and specific county level or equivalent <br />Operational Order /Fragmentary Operations Order with an embedded estimated <br />operational budget has been reviewed and approved through an official electronic <br />mail notice issued by FEMA removing this special programmatic condition. <br />Funds Transfer Restriction <br />The recipient is prohibited from transferring funds between programs (includes <br />SHSP, UASI, and OPSG). Grantees are allowed to submit an Investment /project <br />where fiends come from multiple finnding sources (i.e., SHSP/UASI); however, <br />grantees are not allowed to divert finding from one program to another due to the <br />risk -based funding allocations, which were made at the discretion of DHS. <br />For additional details on restrictions on the use of funds, refer to Appendix C — <br />Funding Guidelines. <br />Ereviraremental Planning andHistorie Preservation (EHP) Compliance <br />As a Federal agency, FEMA is required to consider the effects of its actions on the <br />environment and/or historic properties to ensure that all activities and programs <br />funded by the agency, including grants- funded projects, comply with Federal EHP <br />regulations, haws and Executive Orders as applicable. Grantees and sub- grantees <br />proposing projects that have the potential to impact the environment, including but <br />not limited to construction of communication towers, modification or renovation of <br />existing buildings, structures and facilities, or new construction including <br />replacement of facilities, must participate in the FEMA EHP review process.
