REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />SEPTEMBER 1, 2015 <br />TITLE: <br />AGREEMENT WITH AMEC FOSTER <br />WHEELER ENVIRONMENT & <br />INFRASTRUCTURE, INC., FOR <br />COMMERCIAL/INDUSTRIAL INSPECTION <br />& DATABASE MANAGEMENT <br />(STRATEGIC PLAN NO. 6, 1 <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1" Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and the Clerk of the Council to execute an agreement with Amec <br />Foster Wheeler Environment & Infrastructure, Inc., subject to non- substantive changes by the <br />City Manager and City Attorney, to provide Environmental Consultant Services for the <br />Commercial and Industrial Inspection and Database Management program, for a three -year term <br />expiring August 31, 2018, with provision for two 1 -year extensions exercisable by the City <br />Manager and the City Attorney, in an amount not to exceed $300,000 per year, for a total <br />amount not to exceed $900,000 over the entire life of the agreement, including any renewal <br />period(s). <br />DISCUSSION <br />Authorized by the Clean Water Act, the National Pollutant Discharge Elimination System <br />(NPDES) permit program was established in 1972 to ensure that unlawful pollutant discharges do <br />not enter the Nation's waterways. In California, this program is collectively regulated by of the <br />State Water Resources Control Board and the nine Regional Water Quality Control Boards. <br />The City, along with several other Orange County cities, is a co- permittee under the County of <br />Orange NPDES permit (Order R8- 2009- 0030 -NPDES No. CAS618030). As a co- permittee, one <br />of the requirements is to inspect commercial and industrial facilities and their operations within <br />the Santa Ana jurisdiction for any potential discharge of pollutants into the storm drain system. <br />Approval of this recommended action will allow the City to perform these inspection and <br />database management services in compliance with the NPDES permit requirements. <br />On April 13, 2015, staff issued a Request for Proposals (RFP) for Commercial /Industrial <br />Inspection and Database Management Consultant Services, and posted the advertisement on <br />the City's website. On May 4, 2015, seven environmental consulting firms submitted proposals. <br />25K -1 <br />
