REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: <br />SEPTEMBER 1, 2015 <br />TITLE: APPROVED <br />AGREEMENT WITH LARRY WALKER ❑ As Recommended <br />ASSOCIATES FOR NPDES AND ❑ As Amended <br />❑ Ordinance on 1" Reading <br />ENVIRONMENTAL PROGRAM FEE STUDY ❑ Ordinance on 2nd Reading <br />(STRATEGIC PLAN NO. 5,2) ❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />CITY MANA R <br />RECOMMENDED ACTION <br />Authorize the City Manager and the Clerk of the Council to execute an agreement with Larry <br />Walker Associates, subject to nonsubstantive changes by the City Manager and City Attorney, for <br />a National Pollutant Discharge Elimination System and Environmental Program Fee Study, for a <br />one -year term expiring on August 31, 2016, with provisions for one 1 -year extension exercisable <br />by the City Manager and City Attorney, in a total amount not to exceed $100,000 for the entire <br />agreement term. <br />Approval of this recommended action will allow the City to perform a comprehensive program <br />analysis and fee study to ensure a proper balance between fees and costs in support of National <br />Pollutant Discharge Elimination System (NPDES) and environmental programs. This analysis <br />will review current and forthcoming Environmental and NPDES permit requirements, current and <br />future watershed pollutant limits, and resource requirements relative to the program cost <br />allocations. <br />In 2002, the City Council approved a fee study for the NPDES program which established the <br />existing fee schedule and revenue model. Since that time, permit and environmental <br />requirements have significantly changed, which makes this comprehensive program review very <br />appropriate. <br />On May 15, 2015, a Request for Proposals (RFP) for NPDES and Environmental Programs Fee <br />Study was issued and posted on the City's website. A mandatory pre - proposal meeting was <br />attended by four engineering firms, and three firms submitted proposals on June 23, 2015. <br />Each proposal was evaluated and ranked by a review committee comprised of Public Works <br />Agency staff. The ranking criteria included the firm's qualifications, understanding the scope of <br />25M -1 <br />
