grievance review process becomes formal. Should the grievant fail to file a <br />written grievance, and in the manner specified above, within ten (10) calendar <br />days after receiving the response from his or her Bureau Commander, the <br />grievance shall be barred and waived. <br />18.3 Formal Process. <br />A. If the grievance is not resolved through the informal process, and a written <br />grievance is filed within the time limits set forth above, the grievant's immediate <br />supervisor and Division Commander will add their comments and any <br />justification they consider proper, sign it, and forward it to their Bureau <br />Commander without undue delay, or in no case, more than seven (7) calendar <br />days after receiving the formal grievance. A copy shall be provided to the <br />employee. <br />B. The Bureau Commander, after study of the case, shall attach his or her decision <br />and reasons therefore, and return them to the employee within seven (7) calendar <br />days after receipt of the written grievance. <br />C. If no satisfactory settlement has been reached at the division level, the employee <br />may, within seven (7) calendar days after receipt of the Bureau Commander's <br />decision may, in writing, request a meeting with the Police Chief to pursue the <br />employee's grievance. Failure of the grievant to take this action will constitute a <br />waiver and bar to the grievance, and the grievance will be considered settled on <br />the basis of the Bureau Commander's response. <br />D. If the grievant files a written grievance to the Police Chief in the matter and <br />within the time limits specified in "C" above, then a conference shall be held at <br />the request of the employee or the Police Chief. <br />E. The Police Chief shall inform the employee of his action within fourteen (14) <br />calendar days of the filing of the written grievance with the Police Chief or the <br />date the conference is held between the employee and the Police Chief. <br />F. If no satisfactory settlement has been reached at the departmental level, the <br />employee may, within seven (7) calendar days after being informed by the Police <br />Chief of his decision on the matter, and the reasons thereof, submit the grievance <br />in writing to the City Manager, or his duly authorized representative, for <br />determination. Failure of the grievant to take this action will constitute a waiver <br />and bar to the grievance, and the grievance will be considered settled on the basis <br />of the Police Chief's response. <br />The City Manager, or his representative, after careful review, shall render a final <br />decision on the merits of the grievance, in writing, and return it to the grievant <br />within twenty -one (21) calendar days after receiving the grievance.
