The determination as to a 30 minute or one (1) <br />hour unpaid meal period shall be made by the Police Chief or his <br />designee. <br />e. 207(k) 9/80 Work Schedule. Employees shall work five (5) nine <br />hour workdays in one (1) seven (7) day span and three (3) nine <br />hour workdays and one (1) eight hour workday in the second seven <br />(7) day span, or alternatively three (3) nine hour workdays and one <br />(1) eight hour workday in the first seven (7) day span and five (5) <br />nine hour workdays in the second span. This cycle shall be <br />repeated twice each 28 day FLSA Work Period. Each nine (9) <br />hour workday shall consist of nine (9) hours of work and either a <br />30 minute or one (1) hour unpaid meal period. The eight (8) hour <br />workday shall consist of eight (8) hours of work and either a 30 <br />minute or one (1) hour unpaid meal period. The determination as <br />to a 30 minute or one (1) hour unpaid meal period shall be made by <br />the Police Chief or his designee. <br />£ 207(k) 9/81 Work Schedule. Employees shall work 81 hours in a <br />consecutive 14 day, 336 hour period. This cycle shall be repeated <br />twice each 28 day FLSA Work Period. Employees shall work five <br />(5) nine hour workdays in one (1) seven (7) day span and four (4) <br />nine hour workdays in the second seven (7) day span. Each nine <br />hour workday shall consist of nine (9) hours of work and either a <br />30 minute or one (1) hour unpaid meal period. While assigned to <br />the 9/81 schedule, an officer shall earn two (2) hours of overtime <br />daring each 28 day FLSA Work Period, unless he or she takes <br />leave without pay during the 28 day, 672 hour period. <br />3.3 Part Time Employment. During the term of this MOU, no presently existing full -time <br />positions will be eliminated as the result of the use of part-time employee(s) and, to the <br />extent possible, when the workload of any one or more part-time employee(s) would <br />justify the addition of a full-time position or positions, the parties will meet and confer <br />regarding the addition of a full -time position or positions, subject to City Council <br />approval. <br />3.4 Code Seven. Except for those employees assigned to Patrol, other employees whose <br />meal periods are interrupted by the performance of job related duties, will receive another <br />full, uninterrupted lunch period or will be compensated for their lunch period at their <br />overtime rate of pay at time and one -half their regular rate of pay. For purposes of this <br />section, "interrupted" shall mean a significant interruption of more than a few minutes <br />(deminimus). For employees who receive a one -hour lunch period (half of which is paid) <br />overtime compensation shall apply only to the unpaid half -hour. Unless exigent <br />circumstances exist beyond the Department's control, employees assigned to Patrol shall <br />D? <br />
