SRC 12/15/15 <br />ORDINANCE NO. NS -XXXX <br />AN URGENCY ORDINANCE OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA, <br />CALIFORNIA, AMENDING DIVISION 3 OF ARTICLE <br />IV OF CHAPTER 2 OF THE SANTA ANA <br />MUNICIPAL CODE REGARDING EMERGENCY <br />SERVICES <br />WHEREAS, NOAA, the National Oceanographic and Atmospheric <br />Administration, is forecasting the arrival of El Nino weather conditions in the winter of <br />2015 -2016; and <br />WHEREAS, cities and counties throughout California are engaged in emergency <br />planning in order to respond to the potential El Nino - related emergencies; and <br />WHEREAS, in both the 1982 -83 and the 1997 -98 El Nino events, cities <br />throughout the State experienced unprecedented property damage and many <br />individuals sustained injuries, which in some cases resulted in fatalities; and <br />WHEREAS, the City anticipates certain emergency situations in the event that <br />the El Nino storms materialize as anticipated; and <br />WHEREAS, Section 415 of the City Charter authorizes the City Council to adopt <br />an Urgency Ordinance when it finds that the ordinance is needed to protect health and <br />safety; and <br />WHEREAS, the Council finds that based on the El Nino predictions and the <br />anticipated consequences of storms this Urgency Ordinance is necessary; <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Sections 2 -402 and 2 -403 of the Santa Ana Municipal Code are <br />hereby deleted in their entirety. <br />Section 2. The first paragraph of Section 2 -404 of the Santa Ana Municipal <br />Codes is hereby deleted and replaced with the following, but all the subsections (1) <br />through (9) shall remain unchanged: <br />"The city manager shall be the director of emergency services. The fire chief <br />shall be the deputy director, who shall act for the director in his absence.
