The report also provides information on which property <br />owners can base their vote on whether to form the AD. <br />Staff recommends the adoption of the following resolutions: <br />1. A resolution that adopts a map which establishes the proposed boundaries of the Warner <br />Industrial Community Assessment District No. 2015 -01 (Exhibit 1). <br />2. A resolution that preliminarily approves the Engineer's Report, sets the time and place for <br />a public hearing, and orders the initiation of assessment ballot procedures for Warner <br />Industrial Community Assessment District No. 2015 -01 (Exhibit 2). <br />3. A resolution that establishes local procedures to implement requirements of Article XIII (D) <br />of the Constitution of the State of California and the Proposition 218 Omnibus <br />Implementation Act applicable to assessment ballot proceedings, including such <br />proceedings for the Warner Industrial Community Assessment District No. 2015 -01 <br />(Exhibit 3). <br />ANALYSIS <br />Upon approval of this recommended action, the general sequential steps to continue forming this <br />Assessment District are as follows: <br />STEP <br />TIME NEEDED <br />ACTION <br />Distribute the assessment ballots to the property owners along <br />with notice of the public hearing. City Council holds the public <br />hearing as scheduled and, upon its conclusion, the assessment <br />1 <br />2 to 3 Months <br />ballots will be tabulated. Votes are weighted by the amount <br />assessed. The "yes" votes are totaled by the sum of their <br />individual and respective assessment amounts and compared to <br />the sum of the "no" votes, with the higher amount prevailing. <br />If the ballots support the formation of the Assessment District, City <br />Council may resolve to form the Assessment District and order the <br />levy of assessments based on the Engineer's Report. City <br />2 <br />1 to 2 Months <br />Council action is required to commit the City's portion of the <br />project funding and award the construction contract. Construction <br />could begin soon thereafter. <br />3 <br />2 to 3 Months <br />Construct and complete the Assessment District improvements. <br />55B -2 <br />
