Adopt Resolution affirming performance bonus for the City Manager. <br />2. Adopt Resolution affirming performance bonus for the Clerk of the Council. <br />3. Approve the Amended and Restated City Manager Employment Agreement. <br />DISCUSSION <br />Annual employee evaluations are required and conducted by Council for the City Manager David <br />Cavazos and Clerk of the Council Maria Huizar in accordance with their employment agreements. <br />The Council conducted Mr. Cavazos's evaluation on January 19, 2016 in Closed Session and <br />Council agreed that Mr. Cavazos, by a vote of 5 -2 (Martinez and Pulido dissented), that he is doing <br />an excellent job as the City Manager. Ms. Huizar's evaluation was conducted by the Council on <br />December 1, 2015 in Closed Session and Council agreed that Ms. Huizar, by a vote of 7 -0, that <br />she is doing an excellent job as the Clerk of the Council. The proposed Resolutions for the City <br />Manager and Clerk of the Council affirm the five percent performance bonus, attached for Council <br />consideration (Exhibits 1 and 2). <br />In addition, the City Council appointed an ad hoc committee to discuss contract amendments <br />requested by the City Manager, The City Manager Employment Agreement contains three <br />amendments and are provided for Council consideration (Exhibit 3): <br />• Compensation for Sick Leave at 15% during the first year, 30% during the second <br />year, and on or after February 16, 2018 entitled to cash out 50% of his unused <br />accrued sick leave or conversion to Retirement Credit upon the same percentages. <br />• Term to run until February 16, 2019 instead of October 21, 2017. <br />• If City Manager dies during term of agreement his estate is entitled to accrued <br />salary and benefits, but not severance. <br />55A -1 <br />
