g <br />CITY COUNCIL MEETING DATE: <br />MARCH 15, 2016 <br />TITLE: <br />OC STREETCAR DESIGN <br />COOPERATIVE AGREEMENT <br />(NON- GENERAL FUND) <br />(STRATEGIC PLAN NOS. 3, 2C, 4B; 6, 1G) <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1a' Reading <br />❑ Ordinance on 2nd Reading <br />[] Implementing Resclutlon <br />Cl Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute a cooperative agreement with <br />the Orange County Transportation Authority, in the amount not to exceed $1,493,469, for the <br />term beginning with Orange County Transportation Authority Board approval and ending one <br />year after the OC Streetcar Project is operational and providing service to the public as intended, <br />for design of the OC Streetcar Project, subject to nonsubstantive changes approved by the City <br />Manager and City Attorney. <br />DISCUSSION <br />On July 7, 2015, a Memorandum of Understanding (MOU) was approved by City Council with the <br />Orange County Transportation Authority (OCTA) for implementation of the OC Streetcar Project <br />(Project). The MOU outlines the general roles and responsibilities for the development, <br />implementation, operations, and maintenance phases of Project between the City of Santa Ana <br />and OCTA. The MOU was subsequently approved by OCTA Board of Directors on July 13, <br />2015. <br />Consistent with the MOU, staff has been working with the OCTA since last fall to review and <br />finalize a Design Cooperative Agreement (Agreement) (Exhibit 1) that details the responsibilities <br />of both agencies moving forward through the design phase of the project. The Agreement <br />specifies areas of responsibility and identifies procedures that will be followed to gain approvals <br />in preparing for the construction phase. Staff has reached consensus with the OCTA on the <br />specific terms and conditions which are documented in the Agreement for the design phase of <br />the Project.
