WHEREAS, on or about December 4, 2012, the City held a public scoping <br />meeting to gather public comments on the proposed Project and its potential impacts on <br />the physical environment; and <br />WHEREAS, on or about October 6, 2014, a draft EIR was circulated for public <br />review and comment; and <br />WHEREAS, on or about October 27, 2014, a Public Hearing was held by the <br />Planning Commission; and <br />WHEREAS, by the close of the 45 -day review period a total of five comments, <br />three written comment letters and two oral comments, were received by the City on the <br />document; and <br />WHEREAS, the City has prepared a Final EIR, consisting of comments received <br />during the 45 -day public review and comment period on the Draft EIR, written <br />responses to those comments, the Mitigation Monitoring Program and the Draft EIR. In <br />addition, the Findings of Fact and Statement of Overriding Considerations for the <br />Project have been prepared. For the purposes of this Resolution, the "EIR" shall refer <br />to the Draft EIR, including all of the technical studies and appendices to the Draft EIR, <br />together with the other sections of the Final EIR, including all of the technical studies, <br />attachments and appendices to the Final EIR; and <br />WHEREAS, the Planning Commission of the City of Santa Ana held a duly <br />noticed public hearing on July 13, 2015, and voted to recommend that the City Council: <br />(1) Adopt a resolution certifying Final Environmental Impact Report No. 2013 -01 and <br />approve the Mitigation Monitoring Program and Statement of Overriding Considerations for <br />the proposed Project; and, (2) Adopt an ordinance approving a second amendment to <br />Development Agreement No. 1999 -01 (DA No. 2015 -02) for the Mater Dei High School <br />campus expansion project; and <br />WHEREAS, on or about March 15, 2016, the City Council held a duly noticed <br />public hearing and at that time considered all testimony, written and oral, and approved <br />Resolution No. 2016 -019, certifying the EIR; and <br />WHEREAS, the Facts, Findings, and Statement of Overriding Considerations <br />Regarding the Environmental Effects for the Mater Del High School Parking Structure <br />and School Expansion Project, is attached hereto as Exhibit A and incorporated herein <br />by this reference; and <br />WHEREAS, the Mitigation Monitoring Program sets forth the mitigation measures <br />to which the City shall bind itself in connection with this Project and is attached hereto <br />as Exhibit B and incorporated herein by this reference; and <br />WHEREAS, as contained herein, the City has endeavored in good faith to set <br />forth the basis for its decision on the proposed Project; and <br />Resolution No. 2016 -019 <br />Page 2 of 7 <br />
