Rents shall be collected by Solari and deposited into the <br />operating account. <br /> <br />All rents shall be due on or before the first working day of each month. Rent is considered <br />delinquent on the second working day of the month. Rents must be paid by cashier’s <br />check or money order. No cash will be accepted. <br /> <br />2. Actions for Late Rents <br />Residents who have not paid their rent by the second working day of the month will be <br />served a Notice to Pay Rent or Quit. Failure to pay rent will result in eviction. Solari may <br />consult with the Owner and Mercy House prior to initiating any legal action against any <br />residents. Solari shall provide the attorney with copies of all documents and request <br />that an eviction be scheduled with the court. Eviction proceedings must follow <br />procedures outlined in the California Civil Code. The household will be charged for the <br />cost of any legal actions the Owner incurs due to the actions of the household. Solari will <br />inform the Mercy House of any late rent payments and notices being sent to residents to <br />that any issue in late rent can be resolved prior to the need for an eviction. <br /> <br />3. Partial Rent Payments <br />Partial rent payments will not be accepted unless specific arrangements with Solari are <br />made in advance of the time when rent is due. Rent is due in full on the first working day of <br />each month. <br /> <br />4. Recovery of Damages in Excess of Security Deposit <br />The full amount of back rent and damages will first be established informally and then <br />formally in a judicial unlawful detainer action so that Guest House may claim damages as <br />part of the court’s judgment. If the damages are significant and the resident's <br />income is determined sufficient, a collection agency may be contacted to secure the <br />judgment. <br /> <br />F. Procedures for Appeal and Grievance <br /> <br />1. Eviction Prevention <br />Notices to perform or quit will be issued by the property manager for lease violations. <br />However, unless instructed in writing otherwise by a tenant, Mercy House Housing <br />Stabilization Case Managers will receive a copy of the notices.
