TTM No, 2016-01 -- Subdlvlslon for Condominium Units & Incluslonary Housing Agreement -- <br />1406 North Harbor Boulevard <br />May 17, 2016 <br />Page 3 <br />In addition to the action taken by the Planning Commission, the applicant Is proposing to satisfy <br />the Housing Opportunity Ordinance (HOO) by providing inclusionary units on-site. In the case of <br />this project, the applicant must provide six (6) for -sale units (15 percent of 38 total units) meeting <br />the affordability guidelines for Moderate income. The applicant is required to submit both an <br />Inclusionary Housing Plan and Inclusionary Housing Agreement to be approved by the <br />Community Development Agency and the City Council (Exhibits B & C). The Inclusionary <br />Housing Agreement will also be recorded against the property. <br />Under the revised Ordinance, projects that submitted an application that was deemed complete <br />prior to August 4, 3015 are considered "Pipeline Projects". in Section 41.1910(b) of the revised <br />Ordinance, pipeline projects "may either construct the inclusionary units pursuant to the prior <br />Housing Opportunity Ordinance (Ordinance No. NS -2925) or pay an In lieu fee calculated by the <br />formula under the prior Ordinance or request to revise its Inclusionary Housing Plan and/or <br />Inclusionary Housing Agreement and pay an in -lieu fee of $9,35 per square foot of habitable <br />space for the entire Project's inoluslonary housing obligation." <br />The City Ventures North Harbor Project application was submitted and accepted on July 29, <br />2015. The Developer has elected to construct inclusionary units under the prior Housing <br />Opportunity Ordinance (Ordinance No. NS -2825), which allows for ownership inclusionary <br />housing units to be sold to moderate income households. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #3 - Economic Development, <br />Objectives #2 (create new opportunities for business/job growth and encourage private <br />development through new General Plan and Zoning Ordinance policies), Objective #5 (leverage <br />private investment that results in tax base expansion and job creation citywide); Goal ##5 - <br />Community Health, Livability, Engagement & Sustainability, Objectives #3 (facilitate diverse <br />housing opportunities and support efforts to preserve and improve the livability of Santa Ana <br />neighborhoods), and Objective ##4 (support neighborhood vitality and livability). <br />There is no fiscal impact associated with this action. <br />AP:rb <br />aplMARopotte4taff Reports for COMM78-09 City Ventures North Harbor= <br />Exhibit: A.
