E. Eviction Policy <br />Eviction for cause must conform to applicable state and local law. Any person, who occupies the <br />real property and is in lawful occupancy on the date of the ION, is presumed to be entitled to <br />relocation payments and other assistance, unless the City determines that: <br />1. The person received an eviction notice prior to the ION and as a result of that notice is <br />later evicted, or <br />z. The person is evicted after the ION for serious or repeated violation of material term(s) <br />of the lease or occupancy agreement, and <br />3. In either case, the eviction was not undertaken for the purpose of evading the obligation <br />to make available the payments or other assistance to which a person may otherwise be <br />entitled. <br />F. Citizen Participation <br />The City conducted several public hearings for the Project on the following dates: June 10, 2013; <br />June 25, 2013; June 26, 2013; July 14, 2014; October 17, 2014; October 28, 2014; November 12, <br />2014; November 18, 2014; August 21, 2015, and; September 3, 2015. As the process for <br />implementing the Project advances, the City will observe the following protocol: <br />1. Provide affected tenants with full and timely access to documents relevant to the <br />relocation program; <br />2. Encourage meaningful participation in reviewing the relocation plan and monitoring the <br />relocation assistance program; including the occupants in the Project area, <br />neighborhood groups and community organizations forming a relocation committee; <br />3. Provide technical assistance necessary to interpret elements of this Plan and other <br />pertinent materials; <br />4. Issue a general notice concerning the availability of the Plan for public review, as <br />required, 3o days prior to its proposed adoption; <br />The City has approved acquisition and relocation activities, which began in September 2015 and <br />would be completed no later than the summer of 2017, with construction scheduled to begin in <br />August 2017, and the Project is anticipated to be completed by August 2018. <br />H. Estionated Relocation Costs <br />The total budget estimated for relocation - related payments for this Project, including a 10% <br />contingency, is as follows: <br />Relocation: $ 2,831,336 (escalated) <br />Contingency at 10%: S 283,134 <br />Total: $ 3,114,470 <br />The estimated relocation budget does not include any payments related to property acquisition, <br />improvements pertaining to realty, or loss of business goodwill.
