5. Representatives of government agencies. <br />E. The private sector members are to be nominated by a business service <br />organization, such as the Chamber of Commerce, and the labor, non - profit <br />and public sector nominations are to be nominated by their respective <br />organizations. The City Council shall review the nominations in order to <br />appoint. <br />F. The City shall serve the proper notice upon the WIB to terminate, due to <br />the fact that the City will no longer be an LWIA under the WIA because <br />WIOA took effect on July 1, 2015. <br />& The establishment of the WDB is necessary in order to bring WIOA funds <br />into the City of Santa Ana. <br />Section 2. The Workforce Development Board ( "WDB ") is hereby established <br />pursuant to the Workforce Innovation and Opportunity Act ( "WIOA ") in order to ensure <br />the involvement of the business community, including small businesses, minority <br />business enterprises, education, labor organizations, economic development agencies <br />and one -stop delivery system partners in workforce investment activities, as well as to <br />lead efforts to develop and implement career pathways within the local area by aligning <br />the employment, training, education and supportive services that are needed by adults <br />and youth, particularly individuals with barriers to employment. <br />Section 3. The Mayor and City Council, after review of the private and public <br />sector nominations for membership, ratifies such nominations and establishes the initial <br />individuals to serve on the Board of the WDB. A list of the Board nominations is <br />attached hereto as Exhibit 1 and incorporated herein by this reference. Hereafter, the <br />individuals who serve on the Board shall be appointed and may be removed and <br />vacancies may be filled by the Mayor and City Council by motion as provided by section <br />901 of the City Charter, to the extent that such Charter provisions do not conflict with <br />the WIOA. <br />Section 4. Pursuant to this Resolution, the Workforce Investment Board is <br />hereby dissolved of all duties and responsibilities, and the newly established WDB shall <br />act to implement the WIOA. <br />Section 5. If any section, subsection, sentence, clause, phrase or word of this <br />Resolution is for any reason held to be invalid by a court of competent jurisdiction, such <br />decision shall not affect the validity of the remaining portions of this Resolution. The <br />City Council hereby declares that it would have passed and adopted this Resolution, <br />and each and all provisions hereof, irrespective of the fact that one or more provisions <br />may be declared invalid. <br />Resolution No. 2016 -031 <br />Page 2 of 4 <br />
