RESOLUTION NO. 2016-044 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AUTHORIZING APPLICATION FOR FUNDING <br />FOR THE BICYCLE CORRIDOR IMPROVEMENT <br />PROGRAM FUNDED WITH CONGESTION MITIGATION <br />AND AIR QUALITY IMPROVEMENT PROGRAM FUNDING <br />UNDER THE MOVING AHEAD FOR PROGRESS IN THE <br />21ST CENTURY AND FIXING AMERICAS SURFACE <br />TRANSPORTATION FEDERAL TRANSPORTATION ACT <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines and <br />declares as follows: <br />A. The United State Congress enacted the Moving Ahead for Progress in the <br />21st Century (MAP -21) Federal Transportation Act on July 6, 2012 and <br />Fixing America's Surface Transportation (FAST) Federal Transportation Act <br />on December 4, 2015, which makes Congestion Mitigation and Air Quality <br />Improvement Program (CMAQ) funds available to the Orange County <br />Transportation Authority (OCTA). <br />B. OCTA has established the procedures and criteria for reviewing proposals. <br />C. The City of Santa Ana possesses authority to nominate bicycle projects <br />funded using Congestion Mitigation and Air Quality Improvement Program <br />funding and to finance, acquire, and construct the proposed projects. <br />D. The Public Works Agency will maintain and operate the property acquired, <br />developed, rehabilitated, or restored for the life of the facilities or activity. <br />E. With the approval of the California Department of Transportation (Caltrans) <br />and/or OCTA, the Public Works Agency or its successors in interest in the <br />property may transfer the responsibility to maintain and operate the property. <br />F. The Public Works Agency will amend the agency Capital Improvement <br />Program (CIP) to include the project if selected for funding. <br />Section 2. The City Council of the City of Santa Ana nominates the following projects <br />and authorizes the City Manager and/or the Executive Director of the Public Works <br />Agency or their designees to submit an application for Bicycle Corridor Improvement <br />Program funding, including all understanding and assurances contained therein, and to <br />provide such additional information as may be required: <br />Resolution No. 2016-044 <br />Page 1 of 3 <br />
