CUP No. 2016-24 <br />July 11, 2016 <br />Page 2 <br />Project Description <br />Clever Leaf is requesting approval of a CUP to allow the on-premise sale of alcoholic beverages to <br />patrons of the restaurant. Pursuant to SAIVIC Section 41-196, eating establishments wishing to sell <br />alcohol to diners require approval of a CUP; however, the use of the property as an eating <br />establishment is permitted by right. <br />The restaurant will combine two units to create a new restaurant space formerly occupied by Harbor <br />Deli and K.I.T. Wireless. Clever Leaf began tenant Improvements in April 2016; Alcohol storage <br />and display areas will consist of less than five percent of the floor area (Exhibits 4 and 5). The <br />proposed hours of operation for the restaurant are from 11:00 a.m. to 11:00 p.m. daily, <br />Proiect Background <br />The subject site, Harbor Promenade, is located on the southwestern border of Santa Ana and <br />contains multiple neighborhood-serving businesses, The development was originally built between <br />1989 and 1990 to host retail and eating establishment uses. Currently, the development contains <br />nineteen units across three buildings, and Clever Leaf will be combining two existing units to create <br />a new restaurant space. A parking analysis has been conducted to confirm that the site contains <br />adequate parking supply (Exhibit 3). <br />Clever Leaf is a new, full-service restaurant specializing in modernized Hong Kong-style barbeque <br />food and cuisine served in an American-style atmosphere and style of service. This is the first <br />restaurant for mother and son team Winnie and Darryl Kwok. Winnie is the owner of the restaurant, <br />and Darryl will serve as the chef and operations manager. The menu will focus on the use of <br />ingredients from local farms and suppliers. The food offerings will be seasonal, making use of <br />organic produce, hormone- and antibiotic-free meat, and seafood from sustainable Sources. The <br />applicant is requesting approval of a CUP to allow the sale of alcoholic beverages for on-site <br />consumption. Clever Leaf intends to provide a unique dining experience with its seasonal offerings <br />and environmentally conscious sourcing. <br />RroLect Anal sis <br />y_ <br />Conditional use permit requests are governed by Section 41-638 of the SAIVIC, Conditional use <br />permit requests may be granted when it can be shown that the proposed project will not adversely <br />impact the community. If these findings can be made, then it is appropriate to grant the Conditional <br />use permit. Conversely, the inability to make these findings would result in a denial.
