Amended and Restated Agreement with USA Waste of California, Inc. <br />(dba Waste Management of Orange County) <br />August 16, 2016 <br />Page 2 <br />tracking and transparency purposes, as well as compliance with State legal requirements. The possibility <br />of amending and restating the current agreement was discussed with Waste Management of Orange <br />County ( "Waste Management ") and they agreed. However, they requested that the City explore the pros <br />and cons of a possible extension of the current agreement for Council's future discussion and direction. <br />The Proposed Agreement does not present any new terms or conditions, nor are there any customer rate <br />changes. It is a consolidation of all of the previous amendments and agreements and identifies a single <br />franchise fee to replace a number of miscellaneous charges and transfers to the City (i.e., Program <br />Surcharge, Administrative, NPDES, and other fees added to the cost of services). All of the fees from <br />residential, commercial, and industrial services will be consolidated and set forth as a single Franchise <br />Fee of 26.15 percent. <br />The City currently collects residential waste service charges and then remits payment for services to <br />Waste Management. The City retains the portion of the service charges related to the City's refuse <br />operation. Waste Management currently collects commercial and industrial waste service charges and <br />remits the related fees to the City. Under the Proposed Agreement, total revenue collection will remain <br />the same. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal #4 — City Financial Stability, Objective #1 <br />(maintain a stable, efficient and transparent financial environment). <br />ENVIRONMENTAL IMPACT <br />There is no environmental impact associated with this action. <br />FISCAL IMPACT <br />Residential and non - residential solid waste revenues will continue to be deposited into the Refuse <br />Enterprise Fund (Account No. 06917002 - various) for budgeted distributions to the Federal Clean Water <br />Protection Enterprise (Account Nos. 05717002 -53723 and 05717002- 53724) and the General Fund <br />(Account Nos. 01117002-50052 and 01117002- 57700). <br />Ote <br />Fred Mousavipour <br />Executive Director <br />Public Works Agency <br />f S is Carvalho <br />ity Attorney <br />FM /MLM /ck <br />APPROVED AS TO FUNDS AND ACCOUNTS: <br />Francisco Gutierrez <br />Executive Director <br />Finance & Management Services Agency <br />Exhibit: 1.
