<br />2016 COPS Hiring Program Award Terms and Conditions
<br />a. This term means a legal Instrument to provide support forth performance of any portion of the substantive projector
<br />program for which you received this award and that you as the recipient award to an eligible subreciplent.
<br />b. The term does not Include your procurement of property and services nee, dod to carry out the project a program (for further
<br />explanation, see Sec. 210 of the attach ment to OMB Circular A -133, "Audits of States, Local Governments, and Non - Profit
<br />Organizations ").
<br />c. A subaward maybe provided through any legal agreement, Including an agreement that you or a subreciplent considers a
<br />contract.
<br />4. subreciplent means an entity that:
<br />a. Receives a subaward from you (the recipient) under this award; and
<br />b. Is accountable to you for the use of the federal funds provided by the subaward,
<br />S. Total compensation means the cash and noncash dollar value earned by the executive during the recipient's or sulereclplent's
<br />preceding fiscal year and Includes the following (for more Information see 17 C.F.R, 229.402(c)(2)):
<br />a. Salary and bonus.
<br />b. Awards of stock, stock options, and stock appreciation rights. Use the dollar amount recognized for financial statement
<br />reporting purposes with respect to the fiscal year In accordance with the Statement of Financial Accounting Standards No, 123
<br />(Revised 2004) (FAS 123R), Shared Based payments.
<br />C. Earnings for services under non- equlty incentive plans. This does not Include group life, health, hospitalization, or medical
<br />reimbursement plans that do not discriminate in favor of executives, and are available generally to all salaried employees.
<br />d. Change In pension value. This is the change In present value of defined benefit and actuarial pension plans.
<br />e. Above- market earnings on deferred compensation which is not tax - qualified.
<br />I. Other compensation, if the aggregate value of all such other compensation (e.g., severance, termination payments, value of life
<br />Insurance paid on behalf of the employee, perquisites or property) for the executive exceeds $10,000.
<br />17. Debarment and Suspension. The recipient agrees not to award federal funds under this program to any party which Is debarred or suspended from
<br />participation In Federal assistance programs.
<br />18. Employment Eligibility. The recipient agrees to complete and keep on file, as appropriate, a Bureau of Citizenship and Immigration Services
<br />Employment Eligibility Verification Farm (1 -9), This form is to be used by recipients of federal funds to verify that persons are eligible to work In the
<br />United States,
<br />19. Whistleblower Protection The recipient agrees not to discharge, demote, or otherwise discriminate against an employee as reprisal for the
<br />employee disclosing Information that he or she reasonably believes Is evidence of gross mismanagement of a federal contract or award, a gross
<br />waste of federal funds, an abuse of authority relating to a federal contract or award, a substantial and specific danger to public health or safety, or
<br />a violation of law, rule, or regulation related to a Federal contract (including the competltlon for or negotiation of a contract) or award. The
<br />recipient also agrees to provide to their employees In writing (in the predominant native language of the workforce) of the rights and remedies
<br />provided in 41 U.S.C. § 4712. Please see appendix F In the Award Owner's Manual for a full text of the statute.
<br />20, Mandatory Disclosure. Recipients and subreclpients must timely disclose in writingto the COPS Office or pass - through entity, as applicable, all
<br />federal criminal lawviolations Involving fraud, bribery, or gratuity that may potentially affect the awarded federal funding. Failure to make required
<br />disclosures can result In any of the remedies, including suspension and debarment, described In the Uniform Administrative Requirements, Cost
<br />Principles, and Audit Requirements for Federal Awards, 2 C.F.R. § 200,338 as adopted by the U.S. Department of Justice in 2 C.F.R. § 2800.101.
<br />21. Conflict of Interest. Recipients and subreclplents must disclose In writing to the COPS Office or pass- through entity, as applicable, any potential
<br />conflict of interest affectingthe awarded federal funding in accordance with the Uniform Administrative Requirements, Cost Principles, and Audit
<br />Requirements for Federal Awards, 2 C.F.R. § 200.112 as adopted bythe U.S. Department of Justice in 2 C.F.R, § 2800.101.
<br />22. Contract Provision Ali contracts made by the award recipients under the federal award must contain the provisions required under 2 C.F.R. Part
<br />200, (Appendix 11 to Part 200— Contract Provisions for Non - Federal Entity Contracts Under Federal Awards), as adopted by the U.S. Departmentof
<br />Justice in 2 C.F.R. § 2800.101. Please see appendix G in the Award Owner's Manual for a full text ofthe contract provisions.
<br />23. Restrictions on Internal Confidentiality Agreements. No recipient or subreciplent under this award, or entitythat receives a contract or
<br />subcontract with any funds under this award, may require any employee or contractor to sign an Internal confidentiality agreement or statement
<br />that prohibits or otherwise restricts the lawful reporting of waste, fraud, or abuse to an Investigative or law enforcement representative of a
