Adopt a resolution approving Conditional Use Permit No. 2016-36 as conditioned. <br />2. Adopt a resolution approving Variance No. 2016-07(a) as conditioned to allow a reduction in <br />required setbacks. <br />3. Adopt a resolution approving Variance No. 2016-07(b) as conditioned to allow the building to <br />exceed the allowable height. <br />Request of Applicant <br />James Gartner, representing 4414 Westminster Avenue LLC, is requesting approval of a conditional <br />use permit to allow the construction of an automatic car wash facility at 4412 Westminster Avenue. <br />Pursuant to Section 41-377.5(b) of the Santa Ana Municipal Code (SAMC), car washes require the <br />approval of a conditional use permit in the General Commercial (C2) zoning district. Further, the <br />applicant is requesting approval of a variance from Section 41-380 to allow a reduction in the <br />required 15 -foot landscaped setback on Westminster Avenue and from Section 41-382 to allow the <br />building to exceed 15 feet in height adjacent to a residential use. <br />Protect Location and Site Description <br />The subject site currently consists of two separate parcels of land and is approximately 1.1 acres in <br />size. The project site is rectangular in shape and is located on the southeast corner of Westminster <br />Avenue and Newhope Street. The western parcel is currently vacant, while the eastern parcel is <br />occupied by an automotive repair use and a vacant retail building. <br />EXHIBIT A <br />31A-3 <br />
