- <br /> • <br /> (f) Award of Contract ' <br /> • <br /> The award of the contract, if it be awarded, will be made by the <br /> City Council within thirty-five (35) days after the date of the opening <br /> of the proposals. <br /> The City Council shall reserve the right to evaluate and weigh <br /> • all factors of experience, financial capability, equipment to be <br /> provided and similar data in making the award. <br /> (g) Execution of Contract <br /> The Contract shall be signed by the successful bidder and returned, <br /> together with the contract bonds, within ten (10) days, not including. <br /> Saturday or Sundays, after the bidder has received notice that the <br /> contract has been awarded. No proposal shall be considered binding <br /> upon the City until the execution of the Contract. <br /> Failure to execute a contract and file acceptable bonds as pro- <br /> vided herein within ten (10) days, not including Saturdays or Sundays, <br /> after the bidder has received notice that the contract has been awarded, <br /> shall be- just cause for the annulment of the award and the forfeiture of <br /> the proposal guaranty. <br /> (h) Examination of Specifications, Special <br /> Provisions, and Site of Work <br /> The bidder is required to examine carefully the proposal specifi- <br /> cations, and contract forms for the service contemplated, a.d it will . <br /> be assumed that the bidder has investigated and is satisfied as to <br /> the conditions to be encountered; the chatacter, quality, and quantities <br /> of service to be performed and the requirements of the specifications, <br /> the special provisions, and the contract. It is mutually agreed that <br /> submission of a proposal shall be considered prima ,facie evidence that <br /> the bidder has made such examination. • <br /> SECTION 2. SCOPE OF SERVICE: <br /> (a) General Conditions <br /> The work to be done under this contract shall include the <br /> furnishing of all labor, material and equipment necessary for, and <br /> the callection of all garbage, trash-and similar refuse within the <br /> City of Santa Ana, as the boundaries now exist or may hereafter alter, <br /> and d the disposal of such refuse at a county dump or transfer station <br /> P <br /> dump, unless otherwise provided for by the City of Santa Ana. <br /> Should the Contractor fail to collect and dispose of refuse set <br /> out or placed for collection as herein provided, at the time required, <br /> after notification by the City and within a reasonable time (which <br /> shall not be more than 24 hours) the City may collect and dispose of <br /> the same and the Contractor shall be liable for the expense incurred. <br /> In addition to any other lawful means of effecting reimbursement from <br /> the Contracts such expense may be deducted by the City from money due <br /> or which may become due the Contractor. All collections shall be made <br /> as -quietly aspossible and no unnecessarily noisy trucks or equipment <br /> • <br /> Page 2 of 42 <br />
