of California, and the Contractor will-be required to observe all c. the terms of any of such laws or ordinances now in effect and as may .. be amended hereafter, and will be required to observe all reasonable- regulations that may be enacted by the City Council of the City of Santa Ana governing the same during the team of this contract. (b) Terms The contract shall be for a period of seven (7) years. It shall become effective as 02 12:01 a.m. on the 1st day of November, 1963, and shall terminate at midnight the 31st day of October 1970. (c) Complaints The City shall receive and record all complaints and communi- cations from persons or businesses being served under the provisions of this agreement. At least twice each work day the Contractor or his agent shall personally appear at the office of the Director of Public works.: or such other location as may be designatef by the Director of Public Works, for the purpose of receiving the :cords of such com- Plaints and commtnications. The Contractor shall, within twenty-four (24) hours thereafter, report in writing to the Director of Public worksas to the action taken or other disposal made of each complaint. (d) Performance Bond The Contradtor shall, prior to the execution of the contract, execute and file With the Clerk of the Council of the City of Santa ✓:O Ana a surety bond in the penal sum of two hundred thousand dollars �� " , �- coditioned upon the faithful performance of said contract by the Contractor and his sub-contractors, if. a_ _ . Said Bond may be written for a term of one year, and may thereafter be renewed by certificate, provided however, that said Contractor agrees to maintain such bond -or bonds in force for the complete tem of this contract-. (e) Default In the event that env party hereto shall be in default of any term, condition or covenant hereunder, the non-defaulting party shall give written notice of same to the designated : gent of the other. Defaulting party shall have five (5) days within which to cure or remedy sane. Ms failure of either partvto so cure or remedy within sai.d period shall terminate the contract. Provided, further, that if, in the opinion of the Director of Public Works, (upon reasonable grounds) the contractor shall continue to neglect or refuse to comply with the regulations of the Director and the terms, covenants and conditions of this contract, the City may, at its option, notify the Contractor of its intention to terminate this contract, which notice shall be given in writing and mailed to the most recent address on file with the Director of Public Works, and this contract shall be terminated sva _ty-two (72) hours from and after the hour said notice is deposited en the United States mail.
