Ordinance Amending Chapter 16 of the Code and <br /> Agreements for Construction and Demolition Solid Waste <br /> January 2 , 1996 <br /> process; those meetings failed to produce a permit process that was <br /> acceptable to the various participants. <br /> Based on the City' s need to recycle this sector of the waste stream <br /> to meet the 50% diversion required by state law in 2000, staff has <br /> met with Ware Disposal and with Great Western Reclamation to <br /> develop agreements for handling the City' s temporary construction <br /> and demolition waste. <br /> Currently, Chapter 16 of the City' s Municipal Code and Great <br /> Western' s agreement with the City limits other contractors to the <br /> collection of temporary construction and demolition material in <br /> roll-off containers. The proposed amendments (to the Code and to <br /> Great Western' s agreement) remove that limitation and allow <br /> contractors to collect temporary construction and demolition debris <br /> in roll-off containers or in bins provided they have an agreement <br /> with the City. These changes are proposed to guarantee the two <br /> companies the same access to the marketplace. <br /> The agreements submitted for Council approval will allow Ware <br /> Disposal and Great Western Reclamation to collect temporary <br /> construction and demolition solid waste through the year 2002 and <br /> will provide recycling of these materials beginning in July 1998 <br /> (eighteen months before the compliance period begins for the year <br /> 2000. ) In addition, both companies have agreed to pay the City a <br /> program surcharge and to indemnify the City against any fines <br /> imposed by the State. <br /> FISCAL IMPACT <br /> There is no fiscal impact associated with this action until July <br /> 1998 . At that time the City will receive a 6% program surcharge on <br /> the gross receipts of the two companies for temporary construction <br /> and demolition materials collected in the City. <br /> o'er (9,A- <br /> James G.
