bin service customers within the City; and, finally, commencing on July 1, 1994 and <br /> for the duration of this Agreement, Contractor shall be required to process at a <br /> MRF all solid waste collected by Contractor from its bin service customers within <br /> the City. <br /> Roll-Off Service <br /> Commencing on July 1, 1993, Contractor shall be required to process at a MRF at <br /> least one third (1/3) of all solid waste collected by the Contractor from its roll-off <br /> service customers within the City. Effective on January 1, 1994, Contractor shall be <br /> required to process two thirds (2/3) of all solid waste collected by Contractor from its <br /> roll-off service customers within the City; and, finally, commencing on July 1, 1994 <br /> and for the duration of this Agreement, Contractor shall be required to process at a <br /> MRF all solid waste collected by Contractor from its roll-off service customers <br /> within the City. <br /> C.6 PROCESSING FACILITY REQUIREMENTS <br /> C.6.1 Facility Requirements <br /> The Contractor will provide or subcontract for processing facility capacity and the <br /> resources necessary to prepare all recyclables for market, and will market or <br /> subcontract for marketing of the prepared recyclables. <br /> The Contractor shall establish a site for its waste processing facility(ies), and any <br /> ancillary facilities including: storage, transfer, and locations for sale or disposition <br /> of recycled materials if applicable. <br /> Establishment of the site may include purchasing, leasing, sub-contracting, or <br /> other arrangements with a new or existing facility. Ownership or leasing shall be <br /> the responsibility of the Contractor. The Contractor will ensure that any facility is <br /> fully permitted, and operated and in compliance with all applicable laws and <br /> regulations. <br /> C.6.2 Documentation of Facility Processing&Diversion Capacity <br /> The Contractor must supply documentation acceptable to the City to demonstrate: <br /> 1) It has all applicable permits. <br /> 2) Proof of guaranteed MRF capacity to process the City's solid waste. <br /> 3) The facility will divert 25% of the City's waste by 1995 and 50% by 2000, in <br /> accordance with the City waste diversion plans. Materials will only count as <br /> being diverted if such diversion is allowed by the California Integrated Waste <br /> Management Act or any related legislation. <br /> 4) The facility will be capable of recovering materials of sufficient quality to <br /> ensure the marketability of these materials. <br /> Page 11 <br />
