(H) As part of the SMaRT Program, the City commissioned a study to assess the impact <br />heavy vehicles travelling within the City have on City streets. The study concluded <br />that approximately 38.1% of the impact is due to refuse trucks and similar heavy <br />vehicles travelling on City streets. As such, the study concluded that the costs of <br />maintaining City streets to offset these impacts may be fairly apportioned to the <br />cost of providing refuse service. <br />(C) Therefore, should the City Council establish the SMaRT Program and should it <br />apportion an amount of street maintenance costs to CONTRACTOR as pant of <br />providing refiise service, those additional costs, as established by ordinance or <br />resolution (the "SMaRT Fees "), may be added as a separate line item by the <br />CONTRACTOR to the customer's service rates and charges, in addition to those <br />authorized herein, <br />44 <br />65A -55 <br />
