Candidates will satisfy background checks consistent with this <br />paragraph and their performance of services under this Agreement. <br />27.5 In the event a record is revealed through the processes described <br />in Subparagraphs 27.3 and 27.4, COUNTY will be available to consult with <br />CONTRACTOR on appropriateness of personnel providing services through this <br />Agreement. <br />27.6 CONTRACTOR warrants that all persons employed or otherwise <br />assigned by CONTRACTOR to provide services under this Agreement have <br />satisfactory past work records and/or reference checks indicating their <br />ability to perform the required duties and accept the kind of responsibility <br />anticipated under this Agreement. CONTRACTOR shall maintain records of <br />background investigations and reference checks undertaken and coordinated by <br />CONTRACTOR for each employee and/or volunteer assigned to provide services <br />under this Agreement for a minimum of five (5) years from the date of final <br />payment under this Agreement or until all pending COUNTY, State and Federal <br />audits are completed, whichever is later, in compliance with all applicable <br />laws. <br />27.7 CONTRACTOR shall immediately notify ADMINISTRATOR concerning the <br />arrest and/or subsequent conviction, for offenses other than minor traffic <br />offenses, of any paid employee and/or volunteer staff performing services <br />under this Agreement, when such information becomes known to CONTRACTOR. <br />ADMINISTRATOR may determine whether such employee and/or volunteer may <br />continue to provide services under this Agreement and shall provide notice of <br />such determination to CONTRACTOR in writing. CONTRACTOR's failure to comply <br />with ADMINISTRATOR's decision shall be deemed a material breach of this <br />Agreement, pursuant to Paragraph 18 above. <br />(WRR0216) <br />Page 32 of 43 <br />(April 4, 2017) <br />
