REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />SEPTEMBER 19, 2017 <br />TITLE: <br />AGREEMENT WITH MGT OF AMERICA, <br />INC., FOR CONSULTANT SERVICES <br />RELATED TO THE INDIRECT COST RATE <br />PROPOSAL <br />{STRATEGIC PLAN NO. 6, 1G} <br />CWf MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 151 Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute an agreement with MGT of <br />America, Inc., for the term beginning September 19, 2017, and expiring on September 18, 2018, <br />with provision for a one-year extension exercisable by the City Manager and the City Attorney, to <br />complete preparation of Indirect Cost Rate Proposal as described in Agreement No. A-2016-199, <br />for a total amount not to exceed the original $45,125, subject to nonsubstantive changes <br />approved by the City Manager and City Attorney. <br />Most of the grants awarded to the Public Works Agency from Caltrans and the Orange County <br />Transportation Authority (OCTA) Comprehensive Transportation Funding Program for the City's <br />Capital Improvement Program (CIP) projects are distributed on a reimbursement basis. To <br />receive the grant funds, Public Works staff must submit detailed reimbursement documentation, <br />as required by the respective funding agencies. However, because the reimbursement requests <br />include both direct and indirect City employee labor costs, an approved Cost Allocation Plan is <br />required that calculates the appropriate Indirect Cost Rate percentage that can be used. Since <br />OCTA requested a third -party review of the annual Indirect Cost Rate Proposal (ICRP) <br />calculations, a consultant was needed to prepare the calculations, identify an appropriate <br />approving agency, and establish a process for obtaining the approvals. <br />On September 16, 2013, at the conclusion of a Request for Proposals (RFP) process, Council <br />approval a three-year consultant agreement with MGT of America, Inc., to provide cost <br />reimbursement services for the Finance & Management Services Agency. Because of pressing <br />deadlines for capital project cost reimbursements, the Public Works Agency requested Council <br />approval to enter into an agreement with MGT for cost reimbursement services related to the <br />CIP. On August 2, 2016, Council approved a one-year agreement with MGT (Exhibit 1) to <br />provide the following services for the Public Works Agency: <br />25H-1 <br />
