REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 17, 2017 <br />TITLE: <br />AWARD OF LEGAL SERVICES AGREEMENT WITH <br />GROSSBERG & HOEHN RELATED TO <br />ADMINISTRATIVE AND LITIGATION MATTERS FOR <br />PERSONNEL, POLICE, AND GENERAL LIABILITY <br />{STRATEGIC PLAN NO. 1,3,4,5} <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 151 Reading <br />❑ Ordinance on 2n° Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute on-call legal services agreement <br />with the law firm of Grossberg & Hoehn related to administrative and litigation matters concerning <br />general liability, personnel and police for a three (3) year term ending on October 16, 2020, with <br />an option to extend the term for up to one (1) year, in an amount not to exceed $500,000, including <br />any extension period, subject to non -substantive changes approved by the City Manager and the <br />City Attorney. <br />DISCUSSION <br />The City Attorney's office handles and manages a variety of transactional and litigation matters. <br />From time -to -time, the CAO will refer administrative and litigation matters to outside law firms with <br />specialized expertise. There is an ongoing need for legal services related to administrative and <br />litigation matters for personnel, police, and general liability as these matters often involve multiple <br />parties, current and former employees and complex legal issues where specific expertise is <br />required to defend the City, its employees and its officials. <br />The City Attorney's office recently conducted a request for proposal process and received four <br />written proposals. Grossberg & Hoehn was selected as the winning proposal. Mr. Grossberg has <br />been an attorney for more than 30 years and represents public entities, public employees, and <br />government pooling authorities in matters ranging from civil rights violations, employment matters, <br />police liability, and general liability matters to complex, multi -jurisdictional matters. He is also called <br />upon to offer legal opinions regarding transactional matters. Mr. Grossberg has vast experience <br />in representing public entities in intricate and politically sensitive issues. He has litigated cases <br />that resulted in published cases and is a frequent speaker and a published author on a variety of <br />different issues. <br />25G-1 <br />
