(17) Commercial Solid Wastes shall mean Solid Waste originating from stores, <br />business offices, commercial warehouses, hospitals, educational, health care, military and <br />correctional institutions, non-profit research organizations and government offices. <br />(18) Compos means the product resulting from the controlled biological <br />decomposition of 3 organic wastes that are source separated from the Solid Waste stream. <br />(19) Composting means a method of waste treatment which produces a product <br />meeting the definition of "compost" herein. <br />(20) Composting Facility means a state permitted Solid Waste facility at which <br />composting is conducted and which produces a product meeting the definition of compost. <br />(21) Construction and Demolition Solid Waste includes Solid Wastes, such as building <br />materials, and packaging and rubble resulting from construction, remodeling, repair and <br />demolition operations on streets, pavements, houses, commercial buildings, and other structures. <br />(22) Contract shall mean this Agreement, entered into between CITY and <br />CONTRACTOR. <br />(23) CONTRACTOR shall mean Waste Management Collection and Recycling Inc., a <br />California corporation. <br />(24) Customer shall mean a user of CONTRACTOR's bin or roll -off container service. <br />(25) Disposal Site shall mean any licensed landfill site permitted by CALRECYCLE <br />for the receipt and ultimate disposition of Solid Waste. <br />(26) Executive Director shall mean the Executive Director of Public Works of CITY, <br />or his or her designate. <br />(27) Food Waste shall mean a subset of Organic Materials including: (i) all kitchen <br />and table food waste scraps, and animal, or vegetable, fruit, grain, dairy or fish waste that attends <br />or results from the storage, preparation, cooking or handling of foodstuffs, with the exception of <br />animal excrement, (ii) paper waste contaminated with putrescible material; and, (iii) <br />biodegradable food service ware designed to disintegrate and biodegrade quickly. <br />(28) Gate Fees shall mean those charges by a Disposal Site for Solid Wastes disposed <br />of at said site. Gate Fees are also known as "tipping" fees and "landfill" fees. <br />(29) Gross Receipts means and includes all revenues actually received by <br />CONTRACTOR arising from, or attributable to, the services provided by CONTRACTOR to its <br />Customers in the CITY pursuant to this Agreement. Gross Receipts include Gate Fees as defined <br />herein. Gross Revenue does not include any revenue received by CONTRACTOR from the sale <br />of Recyclable Solid Waste. Notwithstanding the above, "Gross Receipts" shall not include any <br />SMaRT Fees collected by the CONTRACTOR from the customer as authorized by Section 7 of <br />Exhibit "C" herein. <br />25F-13 <br />
