(30) Hauling Charges shall mean those portions of the curbside, bin, roll -off and other
<br />rates provided for in this Agreement which compensate CONTRACTOR for the Solid Waste
<br />collection and transporting services required of CONTRACTOR under this Agreement. The
<br />parties have agreed upon the initial Hauling Charges as set forth hereinafter, and such charges
<br />are subject to adjustments as provided in this Agreement.
<br />(31) Hazardous Wastes are those wastes which, because of their physical or chemical
<br />characteristics, and are defined as a "hazardous substance" or "hazardous waste" pursuant to the
<br />Resource Conservation and Recovery Act' ("RCRA"), cannot be disposed of in a Class III
<br />landfill under the applicable laws and regulations of the State of California.
<br />(32) Household Hazardous Waste or HHW means Hazardous Waste generated at a
<br />residential property within the CITY. HHW includes, but is not limited to: paint, stain, varnish,
<br />thinner, adhesives, auto products such as old fuel, batteries, Household Batteries, fluorescent
<br />bulbs, tubes, cleaners and sprays, and pesticides, fertilizers, and other garden products.
<br />(33) Industrial Solid Wastes means Solid Waste originating from mechanized
<br />manufacturing facilities, factories, refineries, and publicly operated treatment works, and/or
<br />Solid Wastes placed in bins and/or roll -off containers.
<br />(34) Materials Recovery Facility means a facility permitted as a Solid Waste Facility
<br />by the California Integrated Waste Management Board for sorting, separating and processing of
<br />Recyclable Solid Wastes as well as the segregation and transportation of non -Recyclable Solid
<br />Wastes to a Disposal Site.
<br />(35) Organic Materials shall mean those Green Waste and Food Waste which are
<br />specifically accepted at the Organic Materials Processing Facility. No Discarded Material shall
<br />be considered to be Organic Materials, however, unless it is separated from Solid Waste and
<br />Recyclable Material.
<br />(36) Organic Materials Processing_ Facilitesshall mean the designated Organic
<br />Materials Processing Facility(ies) or such other facility selected by the CONTRACTOR and
<br />approved by the CITY, which is designed, operated and legally permitted for the purpose of
<br />receiving and processing Organic Materials including Green Waste and Food Waste.
<br />(37) Permitted Solid Waste Facilitv means a Solid Waste facility for which there exists
<br />a Solid Waste Facilities Permit issued by the local enforcement agency and concurred in by
<br />CALRECYCLE.
<br />(38) Person shall include, without limitation, associations, clubs, societies, firms,
<br />partnerships, sole proprietorships, corporations, schools, colleges and all governmental agencies
<br />and entities, as well as individuals, including the officers of such associations, corporations, etc.
<br />(39) Processing means the reduction, separation, recovery, conversion or Recycling of
<br />Solid Waste.
<br />(40) Processing Charges shall mean those portions of the curbside, bin, roll -off
<br />container and other rates provided for in this Agreement which compensate CONTRACTOR for
