REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />5, 2017 <br />TITLE: <br />ADOPTION OF A SIDE LETTER <br />AGREEMENT WITH THE SANTA ANA <br />POLICE OFFICERS ASSOCIATION <br />(SAPOA) <br />(STRATEGIC PLAN NO. 7,4 & 6) <br />• g MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />-:• <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1s' Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adoption of a Side Letter agreement modifying the Memorandum of Understanding with the <br />Santa Ana Police Officers Association (SAPOA) regarding wages and other terms and <br />conditions of employment with a term of 12 months from July 1, 2017 through June 30, 2018. <br />DISCUSSION <br />The City and the SAPOA recently agreed to the terms outlined in the attached side -letter <br />agreement modifying the Memorandum of Understanding (MOU). The terms of the side letter <br />include the following. <br />1) Salarv: Effective January 1, 2018, the base salary of all non -sworn employees covered by <br />the MOU shall be increased by two percent (2%). <br />2) Personnel Board: The City and the Union agree that in cases where disciplinary action(s) <br />can be appealed to the Personnel Board, the employee and the City may by mutual <br />agreement delegate the hearing of the appeal to a Hearing Officer. The Hearing Officer shall <br />be a neutral individual with training and experience in administrative law and due process <br />that shall conduct an evidentiary hearing and make findings on employee disciplinary <br />appeals. Such findings and recommendations shall be submitted to the Personnel Board. <br />The Personnel Board shall consider the Hearing Officers report within sixty days after it is <br />issued. The Personnel Board has the power to adopt, modify or reject the findings and <br />recommendations of the Hearing Officer based upon the record. The City shall pay for the <br />Hearing Officer. <br />25A-1 <br />
