A period of earlier service does not apply toward vacation accumulation <br />when an employee has had a break in continuous service, unless the break <br />in service is concluded by reappointment, as provided in Section 9-114 of <br />the Civil Service Rules and Regulations, or by reemployment from layoff <br />within one (1) year. Leave of absences without pay, as provided in Article <br />X - Other Leaves of Absence, Section 10.1 E - Sick Leave — Extended; <br />Article X — Other Leaves of Absence, Section 10.8 - Authorized Absence <br />Without Pay - Long Term; and Article XXIII — Miscellaneous Provisions, <br />Section 23.3 - Catastrophic Leave, do not constitute a break in continuous <br />service as used in this section; however, the leave of absence period shall <br />not be applied toward the accumulation of vacation. Absences due to <br />military leave followed by reinstatement, as provided in Section 9-143 of <br />the Civil Service Rules and Regulations, do not constitute a break in service, <br />and the period of absence on such military leave shall be applied toward the <br />accumulation of vacation. <br />G. Vacation Bu Back. <br />Employees covered by this MOU shall be given an option once per fiscal <br />year, to receive cash compensation computed on a straight time basis in lieu <br />of up to a total of one hundred (100) hours of their banked vacation leave <br />benefits. <br />9.3 Limitation on Vacation. With the exception of a retiring employee, no employee is granted, <br />and no employee shall be allowed to take any vacation leave with pay in excess of fifty <br />(50) working days or four hundred (400) hours in any one year. <br />[This section intentionally left blank] <br />481 <br />25B-40 <br />
