ARTICLE III <br />3.0 ATTENDANCE, WORKDAY & WORKWEEK <br />3.1 Attendance. Employees covered by this MOU shall be in attendance at their work during <br />hours prescribed by the Department Head or his/her designee(s) and shall not absent <br />themselves without approval of the Department Head or his/her designee(s). <br />3.2 Hours of Work. Eight (8) hours of work shall constitute a normal day and forty (40) hours <br />of work shall constitute a minimum workweek, except for employees for whom special <br />regulations have been approved by the City Manager as follows: <br />A. 4/10 Work Schedule for Code Enforcement Officer, Police Department Employees, <br />and Selected Fleet Services Employees The Department Head, with the approval of <br />the City Manager, may assign these employees to a workweek consisting of four <br />(4) ten (10) hour days with an additional one-half (1/2) or one (1) hour for unpaid <br />lunch as negotiated with the Union. The assigned employee shall work four (4) ten <br />(10) hour days and shall have three (3) consecutive days off in a workweek. Upon <br />mutual agreement between the supervisor and employee, the employee may waive <br />his or her right to three (3) consecutive days off in a workweek. The regular <br />workweek shall consist of forty (40) hours. A regular day off shall consist of ten <br />(10) hours. <br />B. 3/11.5, 1/5.5 Work Schedule For Correctional Records Employees. The <br />Department Head, with the approval of the City Manager, may assign these <br />employees to a workweek consisting of three (3) eleven and one-half (11.5) hour <br />days and one (1) five and one-half (5.5) hour day, with an additional forty-five (45) <br />minutes for unpaid lunch as negotiated with the Union. The assigned employee <br />shall have three and one-half (3.5) consecutive days off in a workweek. Upon <br />mutual agreement between the supervisor and employee, the employee may waive <br />his or her right to three and one-half (3.5) consecutive days off in a workweek. <br />The regular workweek shall consist of forty (40) hours. A regular day off shall <br />consist of either eleven and one-half (11.5) hours or five and one-half (5.5) hours. <br />C. 9/80 Work Schedule. The work schedule described below is known as the 9/80. <br />The 9/80 work schedule is designed to be in compliance with the requirements of <br />the Fair Labor Standards Act (ELSA). In the event that there is a conflict with the <br />current rules, practices and/or procedures regarding work schedules and leave <br />plans, then the rules listed below will govern. <br />Employees shall be permitted to work a 9/80 work schedule when authorized by <br />the Department Head and approved by the City 'Manager. A departmental work <br />unit will not be permitted to work this schedule if in the discretion of the <br />Department Head and City Manager, the 9/80 work schedule may reduce service to <br />the public. <br />5 <br />25B-7 <br />
