Authorize the City Manager and the Clerk of the Council to execute the proposed Extension of <br />the Fourth Amended and Restated Agreement for Collection and Handling of Solid Waste with <br />Waste Management Collection and Recycling, Inc. (dba Waste Management of Orange <br />County), extending the expiration date to June 30, 2020, with provision for a one-year renewal <br />exercisable by the City Manager and the City Attorney, and including the implementation of <br />programs addressing the unfunded legislative mandates in California State Assembly Bills <br />1826 and 341, subject to nonsubstantive changes approved by the City Manager and City <br />Attorney. <br />2. Approve an appropriation adjustment appropriating $672,000 from prior year fund balance in <br />the Refuse Collection Enterprise Maintenance revenue account, and appropriating the same <br />amount into the Refuse Collection Service expenditure account. <br />3. Review the Draft Solid Waste Services Request for Proposals. <br />DISCUSSION <br />On October 3, 2017, City Council directed staff to complete negotiations of a short-term contract <br />extension with Waste Management Collection and Recycling, Inc. (dba Waste Management of <br />Orange County, previously USA Waste of California, Inc.). These negotiations are now finalized <br />and staff is recommending a two-year extension (Exhibit 1). The extension includes <br />programming to address the unfunded State legislative mandates for organics (Assembly Bill <br />1826) and commercial/multi-family (Assembly Bill 341) recycling education and outreach. It <br />allows for immediate implementation of education and outreach programming, bringing the City <br />into compliance with State requirements. <br />65A-1 <br />
