forwarded to the Union within fifteen (15) calendar days of receipt by the <br />City. The Union shall have fifteen (15) calendar days after receipt of a <br />request for religious exemption to challenge any exemption granted by the <br />City Manager or his or her designee. If challenged, the deduction to the <br />charity of the employee's choice shall commence but shall be held in escrow <br />pending resolution of the challenge. Charitable contributions shall be by <br />regular payroll deduction only. For purposes of this section, charitable <br />deduction means a contribution to one *of three non-profit organizations, <br />with the United Way being one of them. <br />D. Maintenance of Dues Payroll Deduction <br />Any employees in this unit who have authorized Union dues deductions <br />on the effective date of this Memorandum of Understanding or at any time <br />subsequent to the effective date of this Memorandum of Understanding <br />shall continue to have such dues deduction made by the City during the <br />term of this Memorandum of Understanding; provided, however, that any <br />employee in the Unit may terminate such Union dues each year during the <br />period February 10 through February 28, by notifying the Union of their <br />termination of Union dues deduction. Such notification shall be by certified <br />mail and should be in the form of a letter containing the following <br />information: employee name, employee number, . job classification, <br />department name and name of Union from which dues deductions are to <br />be cancelled. The Union will provide the City with the appropriate <br />documentation to process these dues cancellations within ten (10) business <br />days after the close of the withdrawal period. <br />E. The Santa Ana City Employees, Chapter 1939/Service Employees <br />International Union Local 721 shall indemnify and hold the City, its officers <br />and employees, harmless from any and all claims, demands, suits, or any <br />other action arising from the Agency Shop or Maintenance of Dues Payroll <br />Deduction provisions herein. In no event.shall the City be required to pay <br />from its own funds, Union dues, service fee or charitable contributions, <br />which the employee was obligated to pay, but failed to pay, regardless of <br />the reasons. <br />Irl <br />25K-50 <br />
