ARTICLE XIX <br />19.0 DUES DEDUCTION & INDEMNIFICATION <br />19.1 Dues Deduction. The City shall deduct dues on a regular basis from the pay of all <br />employees covered by this MOU who voluntarily authorize such deduction in <br />writing and on a form to be provided for this purpose by the City. The City shall <br />remit such funds to the Union within thirty (30) calendar days following their <br />deduction. <br />19.2 Agency Shop. <br />A. All employees represented by the Santa Ana City Employees, <br />Chapter1939/Service Employees International Union Local 721, shall, as a <br />condition of continuing employment become and remain members of the <br />Union or shall pay to the Union a service fee in lieu thereof. The service fee <br />shall be an amount not to exceed the standard initiation fee, periodic dues <br />and general assessments of the Union. <br />B. Any employee hired by the City subject to this MOU shall be provided, <br />through the Personnel.Services Department, with an authorization form for <br />the deduction of Union dues. Employees shall have thirty (30) working <br />days following the initial date of employment to fully execute the <br />authorization form and return it to the Agency/Department payroll section. <br />The effective date of Union dues, service deductions or charitable <br />contribution for such employees shall be the beginning of the first pay <br />period of employment. <br />.C. Any employee of the City subject to this MOU who wishes to execute a <br />written declaration claiming a religious exemption from paying Union <br />dues, and who is a member of a bona fide religion, body or sect which has <br />historically held conscientious objections to joining or. financially <br />supporting a public employee organization and which is recognized as <br />such by the Public Employer Relations Board, shall, upon presentation of <br />verification of active membership in such religion, body or sect be <br />permitted to make a charitable contribution equal to the service fee in lieu <br />of Union membership or service fee payment to one of three designated <br />nonreligious, non -labor, charitable fund exempt from taxation under <br />Section 501(c)(3) of the Internal Revenue Code.
