a. If the Executive Director does not support the employee's request for <br />a classification review, he or she shall notify the employee of this <br />decision in writing and set forth the basis for the decision. <br />b. If the Executive Director does not support the employee's request, <br />but agrees that some of the duties and/or responsibilities being <br />performed by the employee are those of a higher level City <br />classification, he or she can do the following: <br />i. Return the employee to performance of the duties and/or <br />responsibilities of their proper classification. <br />ii. Eliminate the higher duties and/or responsibilities being <br />performed by the employee, for which the City has agreed are <br />those for which it shall provide higher compensation. <br />B. Any employee request for classification review approved by the Executive <br />Director shall be forwarded to the Executive Director of Personnel Services. <br />The Executive Director of Personnel Services shall confirm receipt of the <br />request in writing to the employee. Within sixty (60) days of receipt of the <br />request, the Executive Director of Personnel Services shall notify the <br />employee and Executive Director of the decision as to whether a study will <br />be conducted. If the Executive Director of Personnel Services determines that <br />a study is appropriate, the Executive Director of Personnel Services shall so <br />notify the employee and the Executive Director in writing and shall provide <br />the employee and Executive Director with an approximate start date for the <br />study. <br />C. Determinations of the employee's Executive Director and the Executive <br />Director of Personnel Services are not final. This process is not subject to the <br />grievance procedures however an appeal to the City Manager or his/her <br />representative shall be presented within fifteen (15) working days of the <br />notification of the findings by the Executive Director of Personnel. The City <br />Manager's decision is final and not subject to the grievance provisions of this <br />MOU. <br />D. All studies and study findings shall require City Manager approval before <br />proceeding. <br />E. All recommendations resulting from study findings require the approval. of <br />the City Council and shall be implemented in accordance with the City's <br />Civil Service rules. <br />EO <br />25K-60 <br />
