City of Santa Ana, California <br />Section 4. RFP Policies, Conditions, and Process <br />research Proposers' past performance by reviewing litigation history, regulatory actions, highway driving <br />records, criminal investigations and recycling history. The Proposer's submission of a proposal shall <br />constitute an agreement to cooperate with the City's review. <br />Unless a submitting Proposer takes specific exception in accordance with the procedure set forth in <br />Section 5.6, submission of a proposal shall constitute acknowledgement and acceptance of all the terms <br />and conditions contained in this RFP and the Draft Agreement including all addenda or amendments <br />issued by the City as per the process provided in this RFP. <br />Submittal of a proposal signifies the submitting Proposers' commitment to provide the proposed <br />services if selected. In addition, all aspects, conditions and components of proposals submitted shall be <br />valid until June 30, 2020.. Proposals may not be altered after submittal, except in response to the City's <br />request for clarification. <br />4.3 Code of Conduct <br />4.3.1 Proposer Code of Conduct <br />Proposer is required to sign the Proposer Code of Conduct (Attachment 2). The code of conduct <br />for Proposers: (i) prohibits ex parte communications with City elected officials; (ii) prohibits <br />giving any gift or monetary compensation to City staff member or consultants; and, (iii) prohibits <br />collusive activities with other potential Proposers. <br />If a Proposer does not sign the code of conduct or violates the code of conduct, the City has the <br />right to disqualify the Proposer from this RFP process. The code of conduct shall be signed and <br />submitted to the City in accordance with instructions provided in Section 5.8.1. Please note: <br />submittal of a signed and notarized Proposer Code of Conduct is required to be submitted <br />according to the timeline shown on Table 1-2. <br />4.4 Proposal Submittal Process <br />Proposer shall follow the proposal submittal process as outlined below. <br />4.4.1 Step One — R.S.V.P to Attend Pre -Proposal Meeting and Submit Proposer Code of <br />Conduct <br />Proposer must submit notification to the City of its intention to attend the mandatory pre - <br />proposal meeting. The date and time of the meeting are provided in Section 1.4, RFP Schedule. <br />Proposer must email notification to: <br />SantaAnaRFP@sloanvazquez.com <br />This notice of intent to attend the are -proposal meeting must be submitted by the date and <br />time provided in Section 1.4, RFP Schedule. <br />4.4.2 Step Two—Mandatory Pre -Proposal Meeting <br />The mandatory pre -proposal meeting will be held at LOCATION TBD, Santa Ana, CA. <br />Attendance at this meeting is mandatory for all contractors intending to submit a proposal.
