(2) Park; or <br />(3) Existing Residential zone. <br />(b) No commercial Adult Use cannabis retail business shall be located within 500 <br />feet of another retail cannabis business, except for permitted co -location. <br />Section 40-7. Exception <br />Commercial cannabis cultivation is expressly prohibited in all zones and all <br />specific plan areas in the City; provided, however, that six (6) plants per private <br />residence may be cultivated indoors within a legally permitted structure for personal use <br />in compliance with Section 18-620 (e) of the Santa Ana Municipal Code and all <br />applicable local and State regulations. <br />Section 40.8. General Provisions for Adu4t-Use Commercial Cannabis <br />Retail Activities in the City of Santa Ana <br />Regulatory Safety Permit Required <br />a. Each Adult Use commercial cannabis fetall business shall obtain a <br />Regulatory Safety Permit (RSP) specific to the business activity defined by the State <br />pertaining to that activity. The only allowed current permit type pursuant to this article is <br />for commercial cannabis Adult Use retail sales and testing laboratories/facilities. <br />b. It shall be unlawful for any person, association, partnership, limited liability <br />company, or corporation to engage in, conduct or carry on, in or upon any premises <br />within the City of Santa Ana any commercial Ad, ilt I Ise cannabis retail business without <br />a RSP. An °� , d 'fie A commercial cannabis fetatl business shall register and obtain a <br />RSP from the City of Santa Ana prior to operation. The RSP applicant shall pay an <br />annual non-refundable application fee in an amount established by the City Council. <br />C. A copy of the RSP shall be displayed at all times in a place visible to the <br />public. <br />d. A RSP shall be valid for a period of one (1) year from the date of issuance, <br />unless sooner revoked. No permit granted herein shall confer any vested right to any <br />person or business for more than the above -referenced period. <br />2. Maintenance of Records and Reporting <br />All records shall be maintained by the commercial Adult-tlse cannabis fetail <br />business for a period of five (5) years and shall be made available by the commercial <br />cannabis business Ar t "__ GRFIREING retail business to an authorized City of Santa <br />Ana representative upon request. If they are not produced as requested, the City may <br />seek a search warrant, subpoena, or court order.
