REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 20, 2018 <br />TITLE: <br />PUBLIC HEARING — ZONING ORDINANCE <br />AMENDMENT NO. 2017-04 TO AMEND <br />PROVISIONS OF CHAPTER 41 OF THE <br />SANTA ANA MUNICIPAL CODE RELATING <br />TO ACCESSORY DWELLING UNITS — CITY <br />OF SANTA ANA, APPLICANT <br />(STRATEGIC PLAN NO. 5, 3) <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1a Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adopt an ordinance approving Zoning Ordinance Amendment No. 2017-04. <br />PLANNING COMMISSION ACTION <br />At its regular meeting on October 23, 2017, a vote of 5:0 (Nguyen and Mendoza absent), the <br />Planning Commission recommended that the City Council adopt an ordinance approving Zoning <br />Ordinance Amendment No. 2017-04 to amend certain sections of Chapter 41 of the Santa Ana <br />Municipal Code (SAMC) regulating the establishment of accessory dwelling units. The Planning <br />Commission recommended adoption of the proposed zoning ordinance amendment with no <br />changes as outlined in the attached staff report (Exhibit A). <br />Staff is proposing to amend certain sections of Chapter 41 of the SAMC to replace the City's <br />second dwelling unit ordinance. Second dwelling units, also known as accessory dwelling units <br />(ADUs), refer to a second home on a property with a preexisting primary home. Accessory dwelling <br />units are seen by many as an important housing option, particularly in cities that have a shortage of <br />housing. They offer a smaller, often more affordable option for renters, allow family members such <br />as seniors or young people a convenient housing option, and offer important assistance for <br />homeowners in paying their mortgage. The City's second dwelling unit ordinance, established in <br />2003, was superseded by changes made to state ADU laws' and is no longer enforceable. The <br />proposed amendments would change the second dwelling unit ordinance to be in compliance <br />with state law by repealing the City's 2003 second dwelling unit ordinance, incorporating new <br />' Assembly Bill 2299 and Senate Bill 1069 that took effect January 1, 2017, and Assembly Bill 494 and Senate Bill 229 <br />that took effect January 1, 2016 <br />75A-1 <br />
